I just realised this date is no good. It clashes with the opening of the Hitchhiker's Guide to the Galaxy. Apple, can we re-schedule?

:)
Yeah, I was all prepared to go to the Apple Store here in Charlotte for the launch of Tiger, but not if it conflicts with me seeing THHGTTG on opening night. Sorry, but you have to have priorities... I just ordered my copy of Tiger from the online Apple Store, and will be content to receive it earlier in the day, in the comfort of my own home, and install it then. :)

Computers/Software constantly being upgraded

I have a hard time having any sympathy for anyone who complains that a vendor hasn't given them a "free upgrade" even if they purchased something 2-3 months BEFORE the upgrade was released (as I've seen posted here a couple of times).

Give me a break - the vendor (Apple/Microsoft/IBM etc) are in business to make money. They give reasonable rules for upgrades. They have the right to set the rules. Put yourself in their shoes... would YOU be giving away free hardware/software to someone who bought 2-3 months ago? (Again reference to those complaining about hardware upgrades - 2-3 months after they bought theirs!)

You go into ANY purchase knowing that something better may come out tomorrow (especially with computers and software!) - Ever buy something only to find out it goes on sale tomorrow? Happens all the time - that's life! The stores set up reasonable rules for getting that new price - but if you're outside the rules most likely your out of luck.

SadSwitcher: It is NOT Apple's fault you purchased before the date of the announcement - especially if you KNEW that Tiger was coming in the first 1/2 of the year (they told you that much). It isn't their responsibility to tell you when they are making announcements - just like stores don't tell you that the item you're buying today is going on sale tomorrow. I can tell you that Apple employees are not told in advance of any announcements so it isn't a lie when they give you their opinion.

Take responsibility for your actions and you'll feel better about your life.

That's my opinion and I'm sticking to it :)

I'm sorry, am I supposed to assume that the sales person in question is the only reliable source for Jetta? Or do you think maybe I could use some common sense and conclude even before confering with others that there is a new model coming soon? Try this: accept your situation, stop running off at the mouth and fingers, and enjoy what you purchased. There's no excuse for ignorance! Figure it out.

You don't assume they're the only reliable source, but BY LAW you can assume that if they LIE to you, it's going to be a problem FOR THEM, not you. Real simple business ethics/law there. Furthermore if a store has a published, printed return policy and then REFUSES to honor it, it's THEIR problem, not yours.

Just becuase you love Apple....

1) They refused this AM read all my posts.
2) Apple support said I had to deal with the store
3) Already shopping it around to people.
4) It's buyer beware up right up to the point where the sales rep lies. BBB 101, try learning it. A mature person would know that.

I read your responses after I posted the suggestion.

If you feel you have a legitimate complaint, try the following, without getting loud, angry or using threats.

1) Return to the store and tell the store manager that: this is your first experience with Apple; that you think that you have not been treated fairly. Give the reasons why, and ask him to work with you to arrive at a solution that is acceptable to both parties. (be prepared to give some ground).

2) If he refuses, tell him that you still are not satisfied and that you want to escalate the matter to his superior (District Manager, I think). Ask him to make the call with you.

3) Take notes at each step

You can use this approach with the store, Apple Support, and Apple Customer Relations department (call Apple headquarters).

You should be able to escalate this all the way up to Steve Jobs, if you think it is warranted.

I have used this approach with several companies and the issue was always resolved to my satisfaction.

The only difference between you and me is I didn't believe my Apple Store sales rep. I was in there two weeks ago and almost made the purchase. He said, "sure we'll upgrade you to Tiger as long as it comes in before July". Didn't sound plausible. Another thing he said is you can return any Apple product within 14 days no questions asked as long as you haven't opened the software discs.

I understand your frusteration, it sucks - but take a deep breath and enjoy life. :)

Apple rep tells me a story.... I buy based on that story.... who's fault is it?

Already tried to take it back this AM, they refused. That was what really prompted my BBB complaint.

Still don't like the garageband name. Think it should have been something else but I'm not creative enough, it should have been iSomething.
The obvious would be "iRock"? I have to say, that title would definitely make me run out and buy a copy.

Exactly HOW did Apple or an Apple store LIE to you?

If an Apple store refused to honor their stated return policy I'd be ticked too.But somehow I don't think that is the case in your situation.

Question from UK perspective -

Student price brings it down to £58 - according to Apple person on phone who took 5 minutes to find out so probs unreliable

Second, can I get the student discount price at an apple store? i.e. hopefuly the Birmingham store will be open by 29th, so can I get it there for student price?

Sadswitcher said he made his Mini purchase 6 days ago or something, theres a big difference between 6 days and 2-3 months.

I purchased my Mini at the end of March and I knew Tiger was coming soon. I decided to go buy it cause I couldn't wait :) I'm still going to give Apple a call to see if I can get an upgrade, but I won't cross my fingers. Panther is 10x better than Windows 2000 which I was coming from. If I don't get an upgrade then I'll use my EDU discount this summer to pick Tiger up.

Sadswitcher, it stinks that right after you purchase your Mini Apple announces Tiger. Call up Apple and explain the situation. If you don't get the upgrade is it that bad? Tiger could be buggy and you might just be better off waiting until you can purchase it and its matured.

You and xsnightclub and 4God seem to miss the point.

The Sales rep lied. Intentionally or not I don't know.
The Store refused to honor its stated return policy.

Those have nothing to do with anything you're saying. If the sales rep had said "I don't know" and the store had honored its return policy I would not be posting as the problem would have been solved.

This is business ethics 101. If I screw up in a purchase it's my problem. If they do.... then in your world apparently its still my problem.

What did I do with my can of Troll-be-gone? I think the only liar here is you. If Apple didn't honor their return policy then hire a lawyer, and be sure to come back and tell us how it went. Now go away.

Nothing really to add to the conversation. Just wanted to say I am glad that it was finally announced. I will probably buy it on the 30th. Don't really want to wait in line the day it's released. I'm hoping I can get a discount through the school bookstore... I will settle for the edu price, but I remember they sold Panther for $15...... fingers crossed!

Yes you should if:

1) The salesperson lied to you about both the impending release of the 2006's and about the upgrade policy.
2) The dealership refused to honor its return policy.

Perhaps this is a better link for you though.

I've been lied to before by sales reps. they say stuff to sell stuff, regardless of the truth. I'm really suprised that people are calling this guy a troll. Fan boys I guess take any criticism of Apple a little too personally.

I would talk to a manager, and explain that you want to return the computer. Inform him/her of any applicable state laws. iff that doesn't work, call your state's attorney general.

I can't believe that other members expect you to take the word of a bunch of nerds of various websites OVER that of a representative of the company.
Sales Reps should know better, but they don't....they want to sell computers, and may stretch the truth.

again, you should be able to return the computer and should pursue any action against Apple to get satisfaction.

Apple isn't perfect. it isn't infallible. They just make sweet computers/software/etc.

One: Apple rep said "if Tiger is released in two weeks" it's free. Guess he was playing word games. He should have said shipped in two weeks. He also told me it wasn't out and that he didn't think it would be out for some time. Dangerously close to a lie there.

If he indeed said "I don't THINK it will be out for some time" then it is obviously his opinion and therefore isn't a lie. IF he had said "we've been told it won't be out for some time" then maybe you have a case.

I agree that the rep's wording was bad on the "released" phrase. You can work with the manager on that one.

Again, I think like the others have said, if you talk to the manager reasonably and make logical points, you may still get the upgrade. But Apple has every right to set up a policy for upgrades and you're outside of it so unfortunately, you may be out of luck.

I also agree with everyone else that you've indeed got a better computer and better OS than you had. So enjoy it and upgrade when you can find the money.

Good luck!

Since you use your mouth hole for spewing a bunch of sh*t, it does not surprise me that you are able to be screwed with your pants on.

Pay for the software you want, otherwise you have no right to bitch about it. I ordered the family pack to pay my just dues, even though you have been able in the past to install OS X on multiple computers.

Seriously, don't you think you're being kind of a jerk? it's not like this guy was using any sort of derogative language. Why bring it down to this level?

:(

And what thread are you reading? Nowhere do I read that any member suggests that anyone should "..take the word of a bunch of nerds of various websites OVER that of a representative of the company." Now if I remember correctly, Steve Jobs is a representative of the company. He posted a Keynote on Apple's website regarding the release of Tiger first half of 2005, right? Hmmmmmm, a rep on a various website. Go figure.

First, Sadswitcher, it's not Apple's fault. The deal at the time you purchased was Mac Mini with Panther. You knew Tiger was around the corner. What do you expect of Apple? The rep to tell you "PSST Don't buy Tiger is due to be announced on the 12th!" Do you expect them to say "Oh, well even though this product wasn't announced offically when you bought your computer, you'll get it for free anyway."

Think about this logically. Bottom line is you purchased something before a free upgrade was announced. Your timing was off.

Second, I was in a similar situation with my 12" Powerbook when Panther came out

Go to http://store.apple.com/1-800-MY-APPLE/WebObjects/AppleStore?partNumber=M9643Z/A

and put in your information. My Powerbook qualified at the time even though it was bought before the cut off.

Just pre-ordered mine from the apple store at £58.75. Don't think Apple stores in the US honour SD so maybe not, maybe call Apple Store in London and ask them?
Panther finally arrived about 2 weeks late last time, so be prepared to wait if you order on line.
