My last post on this subject. Some of you may now cheer.

1) I registered here after I searched for "mac news forum" on google and found this as the first forum listed. I saw there was a discussion on the Tiger announcement and thought that this might be a place to talk about my situation.

2) My question... yes and no. Several people here have provided helpful replies or PMs. No, in that some people assume that because they love Apple, Apple must be by definition fair and honest in their dealings at all times. So I've tried to explain myself, but to no avail.

3) Yes, I do. But unfortunately I have exhausted all of the suggestions give to me here publically and privately.

I was lied to by the sales rep (or misled, whatever verb you prefer). It was probably unintentional but it did happen. The sales rep told the manager he couldn't remember the conversation but he was nice and said that he might have "misspoken". I had a colleague with me and he verified (albeit he's not a disinterested third party) what was said.

I was also refused any return of my product, despite my being within the return window. I took my mini to the store and told them I wanted to return it, and then buy another so that I could get the upgrade. In hindsight I should have said I wanted to return it because it's a POS or some other reason. The store manager used my reason for the return as the reason why they wouldn't accept the return and would not allow me to change from an exchange to an outright refund. I was told that the store has discretion to refuse returns despite what the return policy says.

The BBB indicated they would forward the complaints to the store and to Apple, but told me that in all honesty it had no power to do much to help if they refused.

I don't have the money to buy more software and while $129 is not much to many here, it is to me. Do I need Tiger? No. But that's not the point. I was given a certain understanding about what I was buying, that understanding was predicated on false and misleading information. As that information was from the sales rep, I expected Apple to remedy the situation or at least honor the return.

4) I will remain a member as long as I own a Mac. I'll be honest that that is a bit up in the air right now, as if Apple simply offered me a refund I'd take it and probably go back to Windows. I've never owned a Mac before, so this was my first. I was very much looking forward to the switch and I may not sell/return the mini, but right now I just don't know which way I'm going to go. I have a friend who might want the mini for his mother. If he is willing to give me what I paid for it, I may go that route and use the money to buy a Dell instead. But again I just don't know and I don't want to make a decision about what computer I'll be using for the next few years while I'm irritated.

5) Not at present, the mini works really well and I had an enjoyable weekend getting it set up. I am looking for a good media player... but am not sure whether to use MPlayer or VLC or something else. Those were the two I found on Google. But then that is the subject for another discussion.

I"m sure it's been a bit of a challenge to move computers when customers start asking about tiger. and I would also wager that some sales reps might be willing to bend the truth or misled/misrepresent (though not lie) to sell computers.

4. You expect new customers to watch steve jobs' speech? This is not some Lyndon LaRouche fansite. Why on earth would any normal person (myself sadly excluded) do that, especially if they aren't already a Mac user? Besides, wouldn't the keynote be dated to "new" information a rep could give a few months later?

It's your fault. Trusting a salesman? HA! It's their job to push the product available, not to look out for you.

On the other hand, we look out for each other around here. I know you found this forum after the fact, but my god man, do some research. A mac mini is one hell of impulse buy. in the mean time, keeping fighting. principle is always worth fighting for (even if many disagree with you).
 
If you look at most any Up-To-Date programs Apple has done, it's always active as of the day of announcement. Most weren't retroactive.

Example:
Person A buys on 4/1
Product announced on 4/2. Will ship 4/15.
Person B buys on 4/3.

Person A = Not eligible
Person B = Eligible

Always how I have understood it. Did you buy this from an Apple Store or someone else? The sales reps may know (I know two personally that work at Apple Retail), but it's in their contract that they can't divulge information, or risk being fired.

He said two weeks... could have easily meant two weeks before shipping, in which he would be correct... actually he'd be wrong, as it's closer to 2 and a half weeks (17 days). Unless he specifically said out of his mouth, "If you buy this today and Tiger comes out in 2 weeks, we will give you the cheap upgrade." then anything else he says is open to interpretation.

Can't say I feel sorry for you though... I've been burned before but it's not like your Mac stops working with 10.4 out.

That is exciting. Hopefully we will see a significant improvement. I have no complaints about my current battery, but faster wake up could be cool, and extra batery power is always good!
 
Developer Tools?

Will you need to upgrade to Tiger to get the latest developer tools (ie XCode2)? Or can you just download and install on Panther?

As previously stated in the thread Apple does have a media trade in form where they will send you Tiger on CD.

Or you can use another Mac as long as both have firewire to install in target disk mode.

The sales rep shouldn't have been quoting any dates since Apple sales reps don't have a clue when new products are coming out. No one tells them until they are officially announced. That way they have deniability.
 
I'd just like to add my voice to those who have preordered Tiger. Deffffffinitely looking forward to installing this on my iBook G4! :D

My one small gripe is that they don't give a price break (like half off or something) to people who shelled out big bucks only a few months ago to buy a new Mac. Just my opinion.

Have you tried to escalate the issue with the Store; with Apple Support; with Customer Relations?

Have you tried to return it through the web page given by another poster?

I suspect that lthe latter would cost you shipping and restocking-- but Apple may choose to waive these if you present a valid case.

I just preordered Tiger from the Apple website. They say it will be delivered
by April 29. There are no shipping options. I checked Amazon, their shipping date was as late as June 1, so I decided to go with Apple. At my age, you don't want to have to wait for things any longer than necessary

I think his main gripe is that the sales person made it sound like they actually knew something... which they did not. NO Apple sales people know anything about upcoming releases. People roll their eyes and say, "yeah right" when they hear this, but it's the truth. They won't know anything until the day it comes out. This sales rep did make the mistake of saying Tiger would be free however for people buying within the two weeks. It's usually a discounted upgrade, not free.
 
The person who mentioned iWorks requires a serial brought up an interesting point:

Do you think Tiger will require a serial?

I'm also curious why the Radeon 9800 Pro was axed from their graphics card list.

I hope you understand this. I actually agree with you. SadSwitcher has valid points, I don't deny that, however, my point was that there are two sides to the coin. I think we all want SadSwitcher to be happy with the switch, I just think that its only fair to offer our input as he did his. I'm sure that if there is just a refund challenge, it can be overcome. As for being a so called fanboy, I don't even own a Mac anymore (will again soon though). I guess I'm just a wannabe instead. Anyways, I have faith that the situation with SadSwitcher will be resolved and will soon be a HappySwitcher. Good luck to you SadSwitcher. :)
