My last post on this subject. Some of you may now cheer.
1) I registered here after I searched for "mac news forum" on google and found this as the first forum listed. I saw there was a discussion on the Tiger announcement and thought that this might be a place to talk about my situation.
2) My question... yes and no. Several people here have provided helpful replies or PMs. No, in that some people assume that because they love Apple, Apple must be by definition fair and honest in their dealings at all times. So I've tried to explain myself, but to no avail.
3) Yes, I do. But unfortunately I have exhausted all of the suggestions give to me here publically and privately.
I was lied to by the sales rep (or misled, whatever verb you prefer). It was probably unintentional but it did happen. The sales rep told the manager he couldn't remember the conversation but he was nice and said that he might have "misspoken". I had a colleague with me and he verified (albeit he's not a disinterested third party) what was said.
I was also refused any return of my product, despite my being within the return window. I took my mini to the store and told them I wanted to return it, and then buy another so that I could get the upgrade. In hindsight I should have said I wanted to return it because it's a POS or some other reason. The store manager used my reason for the return as the reason why they wouldn't accept the return and would not allow me to change from an exchange to an outright refund. I was told that the store has discretion to refuse returns despite what the return policy says.
The BBB indicated they would forward the complaints to the store and to Apple, but told me that in all honesty it had no power to do much to help if they refused.
I don't have the money to buy more software and while $129 is not much to many here, it is to me. Do I need Tiger? No. But that's not the point. I was given a certain understanding about what I was buying, that understanding was predicated on false and misleading information. As that information was from the sales rep, I expected Apple to remedy the situation or at least honor the return.
4) I will remain a member as long as I own a Mac. I'll be honest that that is a bit up in the air right now, as if Apple simply offered me a refund I'd take it and probably go back to Windows. I've never owned a Mac before, so this was my first. I was very much looking forward to the switch and I may not sell/return the mini, but right now I just don't know which way I'm going to go. I have a friend who might want the mini for his mother. If he is willing to give me what I paid for it, I may go that route and use the money to buy a Dell instead. But again I just don't know and I don't want to make a decision about what computer I'll be using for the next few years while I'm irritated.
5) Not at present, the mini works really well and I had an enjoyable weekend getting it set up. I am looking for a good media player... but am not sure whether to use MPlayer or VLC or something else. Those were the two I found on Google. But then that is the subject for another discussion.
