I walked into my local 3 shop at about 1.30pm this afternoon, and pre-ordered a 32GB black iPhone 5. £37/month, £79 for the actual phone, 500 texts, 5000 minutes and unlimited data. In and out in 10 minutes, with a piece of paper with my reservation for the 21st!

Easy.
 
i live in milton keynes so not in the sticks and its a generic email that everyone gets once they do a credit check... the ppl on the phone say they dont give dates just a generic within 30 days of release.

suppose it means it could be friday but im starting to doubt it! why not give a date to ppl who ordered early and push it back as they sell out??
So it is the generic email that they send to everyone once your credit check has been completed and accepted?
 
Just ordered a black 32GB on Vodafone website. Got the confirmation email for estimated delivery on the 21st, seem too good to be true to me consider I read Apple online store has already moved to 2 weeks delay, still fingers crossed.

1st iPhone after owning countless Androids, Blackberrys and Nokias, so the iPhone will have lots to live up to.
 
Oh dear, legally, I believe I paid for it - in that I was led to believe that it was included. The words were explicit in that, "Your iPhone includes a Lightening to 30-pin Adapter for connecting accessories and devices featuring the Lightening connector.".

I will await further advice from Apple as and when it comes.

Hmm. I know in shops it isn't false advertising if they correct their mistake as soon as possible... not sure for this. Since they are already reserving money it might count as the contract having been made, in which case they could possibly be held to it. On the other hand I expect they will inform us of the mistake by email, and give us a chance to cancel/return at their expense if we now don't want it, which may well cover them.

Yep i belive so, ive read a few otehrs on here have had the same thing .. it reads -

"thanks for your order of the new iPhone 5. I need to make you aware how this is going to work.

well aim to get your phone to you within 30 days of launch" and so on

Not a bad deal. Works out only £8 more expensive than a contract-free phone with £15/month rolling contract.

They've already taken my money, (debit card), thus I concur that the contract of sale has already been made.

It would appear that they corrected their mistake as soon as they found out, but it did take quite a while - which brings up why adequate checks weren't made - because the wording was very specific.

But yes, I agree with what I hope that they will do.

I'm going to call back on Monday and see what they have to say. I expect by then they'll have decided on what their stance is. It's a tricky one, also because it was free, so technically I didn't pay for it.
 
I really hope Three offer this soon. It's the only thing I miss about O2.

Got a reply from 3's twitter yesterday, saying that they have NO plans to offer visual voicemail, that it's a business decision, and the final call has been made.

Delighted to see that EE are going to be offering it though. That's me sewn up as a new customer for them as soon as they launch.

Technically, when you pay for something, you aren't just paying for it, well not in this case; you're paying for the whole package: the bits which come with it and even the box.

Looking at the T&C on the store I think the most relevant section is:
2.6 Whilst we will make every effort to supply you with the Products listed on the Order Confirmation, there may be occasions where we are unable to supply these Products because, for example, (i) such Products are no longer being manufactured or available or (ii) we are unable to source relevant components or (iii) if there was a pricing error on the Apple Store Web Site. In such circumstances we will contact you to inform you and may suggest alternative Products that you might wish to purchase. If you do not accept our suggestions then we will cancel your Order in relation to those Products we cannot supply and repay you any money that you may have paid to us in respect of those Products. In the event of a typographical error or technological error causing a mistake in price to be shown, Apple reserves the right to correct the error and to charge you the correct price. Before it does so, Apple will notify you of the mistake and will offer you the opportunity of a full refund. You will receive a notification with or prior to your delivery. Subject to clause 11.4 below, repayment of such monies will be the extent of our liability to you if we are unable to deliver to you the Products you have ordered.

Notably they specify "typographical error or technological error causing a mistake in price to be shown", but don't seem to mention anywhere errors in product descriptions/listings, which surprises me. None of the terms they list there seem to me to get them out of sending us the adapter (though I'm not a lawyer). I will wait to see what comes of this.

Its an odd one, I always thought the ruling was companies dont have to honour a deal it if is obviously an error (like when you see TVs on sale for 7 pound when it should be 700 pounds)

In this case you can argue that the wording doesnt make it seem like an obvious error from apple.

Mose likely outcome is eventually a free adaptor for everyone (like the bumpers for the iPhone 4)

Apple dont really want the bad press this can cause, and its obvious that at one point they intended to give a free adapter (otherwise it would never have been on their site)

I believe pricing is very specific and pricing is the exception.

As we ordered online, the Sales of Good Act and Distant Selling Regs say that it must match the product description (written/oral etc), but it doesn't say much about errors.

That's the poorly worded email I got! Hopefully it will still be launch day..?
 
The annoying part for me is that by the time I found out that it was an error and that I wouldn't be getting one, the ship dates had slipped to October.
 
3rd shop lucky!! Went to 3 Three stores around my area and 2 of them said they weren't giving nano sims out until the 21st. Finally found the smallest 3 store in the world to transfer my micro sim to nano sim (with the 2 adapters and without the £5.11 charge!) Not tried the sim yet however... but if all goes to plan I'll be up and running on the 21st.

Also to all new 3 customers, expect POOR customer service via phone, as their call centre is in India (or maybe Leicester), and half the time do not have a clue what you're going on about. Good luck!!

By the time I had found out that it was an error, the times also had already slipped - we weren't in a favourable position to attempt to rectify this error and make a change in decision.

Ok. Apparently the availability was always October for the adaptors. From the MacRumors front page here:

A number of readers have noted that the adapters have been listed as shipping in October since they first showed up in Apple's online store on Wednesday. Shipping estimates on the USB cable have, however, indeed slipped.

That would be the case, however, I think most of us are trying to get the iPhone before October. I believe even Apple said to make multiple orders.
