Reluctant to go to Apple as I'll get given a replacement rather than a brand new

I suspect all warranty replacements are still new even if they are white box so you may want to consider swapping it out. The only downside is the serial number on your phone will not match that on your original box.

To be honest with you, having had Apple's warranty refurbs twice before, I really wouldn't be concerned about it. As Mr.C said, because of how new the models are it's likely that warranty stock are actually new... But even if they're not, Apple refurbs are some of the best in any business.

To refurb an iPhone, I believe Apple have them back, return them to like-new condition, give them burn in tests to ensure that the devices are fault free (something that either doesn't happen with new devices, or if it does certainly not to the same extent), and then they re-package them. They come with the same guarantees and warranties as your original phone (I think the warranty date remains as your original purchase because that's all UK law requires).

All-in-all, Apple refurb stock are as good as new - or maybe better because of the extra testing.

I think if you've tried everything including a fresh start and setting up as a new phone, then that's the right thing to do. I had battery and weird behaviour problems in the first few days, but a restore sorted it and my 6s is now performing really well under 9.1 beta. I found 9.0.1 to be bad on battery.

I do think it's worth a shot. We are now on public beta 5 and I've found it to be smooth and stable with good battery life. I would recommend starting from scratch though, not a backup, so any problems you had won't get carried over. It's got to be worth a try.

Head over to https://beta.apple.com/sp/betaprogram/ and sign up. You download a profile and then the beta is available on your phone with software update. It's really straight forward. Doing it this way will just upgrade your phone keeping the current content. You could see if that helps, and maybe reset the phone after if needed.

An alternative way is to download the ipsw file and do a clean install from iTunes.

Isn't the Unicorn cute? How is your phone running now? Battery might take a day or two to settle as the new update might be doing stuff in the background etc.
So far so good, can't tell yet as I need some of the mystery contacts to text me yet
 
Just installed beta 5, must say that performance is slightly improved despite being a beta. But is it just me, or is there a delay with Touch ID on the lock screen? It just doesn't seem as snappy as it was before.

We're currently on beta 5, so there are a few bugs that need ironing out and general iOS needs polishing. But in terms of usability, it's completely fine and safe. I say you go ahead!
I've followed the instructions and backed up my phone, saved the backup but it just says 9.0.2 is up to date? What's the next step?
