I have this guys Name, email address, and cell phone number and he is unwilling to return my money for this product.

no i honestly dont think so, i found him on myspace, and his vmail has his name and voice, i also looked up the provider, he has Verizon, and i doubt its a pay as u go plan, I also know where he lives, just not the exact apartment.... i have my ways of finding him tho and confronting him in person

I would tell him about the 3 day return law in FL. If he still contests then report him and mention the 3 day law to the authorities. Save those emails that have him denying giving your money back with the date of them. Also try to have proof of date of purchase.. save MySpace messages etc...

I would pursue this. If nothing else get him for copyright infringement for selling a backwards Apple fake iPhone :D

That's a strange course of action to take. I would write a letter to the police and include his contact information. Better yet, just pick up the phone.

EDIT:

When I wrote "pick up the phone" I meant a REAL phone. Just wanted to be clear.
 
For god's sake quit F*$king around and file a police report to have it on record. Provide all the info you have to the authorities and they can probably get an address. Then, file a claim in local small claims court. He will be required to appear and if he doesn't, you will be given default judgment in your favor and can legally have his wages garnished to collect. Scammers like this cave as soon as they know you mean business. If he doesn't you'll most likely get your money back anyway, you'll just have to work harder for it. You may even get more than you lost back for him wasting your time. Begging for your money back will do you no good. File a claim in small claims for the MAXIMUM amount allowed (usually $2K-3K) and have him served to appear in court.


P.S. Please, PLEASE use this as a lesson to educate yourself on what you are buying before you go to buy it. 99.999999999% of successful scams are the result of an uneducated buyer.

I had a little bit of sympathy for you before when I thought you never got to see the Iphone before you purchased it. But knowing you saw it and looking at the pictures it's pretty much your fault man

You've been had, consider this a life lesson and move on ( file a police report, but apple isn't going to help you)

But the guy was advertising an iPhone. This clearly wasn't an iPhone so he shoudn't be advertising it as one.

But as the OP has stated it is partially his fault for not being able to tell the difference between the two. Like said, he had it in his hands before exchanging, the only thing is had he had known, he wouldn't have been in this position in the first place.

Clocks ticking, take some advices and make moves.

Caveat emptor. Bummer on the iPhony, but who drops $275 that impulsively? A real iPhone is only $199 (albeit with 2 year contract). I love the manual with the backwards :apple: logo and it just says "Phone." To those of you saying that Apple won't do anything, they might not be able to help him get his money back, but they'd probably be interested to know about this and might help with prosecuting.

Regardless of the fact that you looked at it but didn't know better, he advertised this as an Apple iPhone. it is not an Apple iPhone. I hope you get your money back.

I notice on that little box by the usb cable that the apple is the right way though...I'd like to take a look at that whole companies operation.

First of all, why would Apple help you?

You're not even an iPhone customer. You're not giving money to Apple. You're not giving money to AT&T. They owe you 'what' exactly?

They would not give you a free iPhone if this is your angle. And they'd have no right to contact your seller.

It is your responsibility.

I don't understand why you've tried to play the part of P.I, investigating his MySpace, e-mail, and mobile company.

You were silly to look at that phone, and think it was the iPhone - yes.
You were lied to - and on those grounds, have a right to get your money back.
Also, it seems your state has a 3-day refund law.

Why on earth didn't you go to the Police on the day this happened? Why would you wait? I just don't get it.

The Police and authorities are going to be far more menacing to this fraudulent seller than you are, knocking on his door with a sad face, or bombarding his MySpace.

If you haven't already - go through the proper channels, and get your money back.

Good luck to you, but stop walking on egg shells - go and get it done.

Looked to me like the seller put one of those Apple stickers you get when buying a Mac on it. Might be another argument for the buyer.
