False advertising. Had your iPhone clone had 8GB's of memory and met the other bits of info, then you'd have no case. But the fact is, you haven't received what you paid for, clone or no clone, so you have grounds to act upon.

First of all, why would Apple help you?

You're not even an iPhone customer. You're not giving money to Apple. You're not giving money to AT&T. They owe you 'what' exactly?

Yes, but if there is an active seller using Apple's iPhone to promote a fake clone, he is stealing Apple's business. People are expecting an Apple iPhone and ending up with a fake. This is all down to the descriptions the seller is using to sell the clone. It is false advertising and using Apple's iPhone to sell it.

Apple may well go after him. They have a whole department just for cases like this.

Of course. But online sales, especially on Craigslist, is easier than market sales to track and take a course of action. If you buy on a market, then you half know you are getting something dodgy and can disappear easily. Buying from the likes of eBay, you have a production description and eBay etc has the seller information.

But what I quoted was the OP angling it as though Apple would have helped him out personally. I'm not saying he was aiming for a free iPhone, but the way he worded:

you would be surprised what some companies do for people who write them letters, its worked for me in the past

Was as though they would give him an iPhone. There is nothing else they could do to personally help him as a buyer.

They could send the seller a nasty letter on the legal grounds that they've used their trademarked name - but they wouldn't do it in a "Oi you, give XXX his money back!"

Guys, don't forget the guy actually looked at the iphone in person before buying it

I don't really care what the the original craiglsist ad looks like, did you check out the manual and all the backward apple logo's

But, I believe I also said:

You were silly to look at that phone, and think it was the iPhone - yes.
You were lied to - and on those grounds, have a right to get your money back.
Also, it seems your state has a 3-day refund law.

Why on earth didn't you go to the Police on the day this happened? Why would you wait? I just don't get it.

The Police and authorities are going to be far more menacing to this fraudulent seller than you are, knocking on his door with a sad face, or bombarding his MySpace.

If you haven't already - go through the proper channels, and get your money back.

Good luck to you, but stop walking on egg shells - go and get it done.

The OP hadn't gone to the authorities at the time. I was telling him that obtaining this information for his own use was useless - the authorities would deal with it far better and he should pass it onto them - not go after the seller him/herself.
