Proof of damages? If there are no damages then it's an FTC problem (improper labeling).

Maybe everyone will get a free eBook while the lawyers pocket a few million in fees?

That's the exception and not norm since most buy from Apple and other resellers with standard 14 day and can't return to Costco.

Ordered a purple iPad Mini when it came out.
Loved the color, but it didn‘t have much (if any at all) benefit in addition to my iPhone 12 PM + iPad Pro 12.9“ combo.

I also noticed the jelly scrolling issue, and it irked me.
Don‘t know if I‘d have noticed if there hadn‘t been such a fuzz about it.

Long story short:
I returned it (first time for a new Apple device) and haven‘t regretted it a bit.

I don’t notice it. I’m a graphic designer, I think I have a pretty good eye for these things.

It probably has less to do with your eyes and more to do with your inner ear/nervous system.

Unless you are saying that you can’t actually see any jelly scroll no matter how hard you look :p
 
Why is everyone always rooting for Apple? it would benefit everyone if they lose this case. Quality products are what we EXPECT from Apple, not this trash.

I don't get it either

Defending Apple helps nothing get better.

A company of their size and clout needs to get forced to change, or they just go endlessly down the rabbit hole of squeezing consumers at every opportunity.

I think - just a pet theory - some folks are sucked in by the Apple PR machine ... and others are living off the memories and visions of "plucky little fighter Apple trying to beat back big bad Microsoft!" -- from 20 years ago now.
 
The biggest non-issue in the history of ever is now a class action lawsuit because you just ran out of things to sue over or what?

Former class action lawyer here. This class will never be certified -- not a chance. It's not even worth reporting, as it is what we call a "nuisance value" lawsuit that will have no material impact on anything.

Maybe not by the books but there's a PR and customer satisfaction aspect so Apple may settle and start a repair/replace service program. Not the first time actually.
 
Does it render the device unusable? It's subjective I guess but don't think so.
If you bought the device for reading and have motion sensitive eyes, then yes, it’s unusable :(. At least for me, scrolling in portrait mode—which is something I do a tremendous amount of between social media, ebooks, websites, etc—should not cause me a minor headache because of jelly scroll. It’s all subjective depending on your eyes, ofc.

This lawsuit does kind of make me laugh though. I wonder if that was actually that guy on the forums back when mini 6 was releeased who was trolling that he wanted a class action lawsuit for this very issue. If it is him, that is some serious dedication.
 
This is good news. It was unbearable and sent mine back as well. Previous mini does not have the problem like this one. I compared it, since my sister has the older one. Even she said no way is that right. Side by side you can totally see the differences. The jelly scroll is real and very distracting. I hope the case is won and will cause Apple not to skimp. They left this defect in using cheaper panels while raising the price trying to get one over consumers.

Bingo. Apple doesn't like catering to smart customers and would rather have customers with low expectations and fat wallets.
 
But does this lawsuit have any legal (or moral) basis? There's a 14 day return window for a reason. It's not a hardware failure that shows up after some time passes; it's a design flaw that is apparent immediately.

I wouldn’t necessarily take the lawsuit at face value. It’s certainly a viable way to communicate strong dissatisfaction and to raise awareness about the problem, regardless of the legal outcome.

Lol on the complaint forums. That’s any article on macrumors anymore. Apple reports record earnings = darn Apple how dare they make any profit and or Cook is/has going to ruin AAPL. You wait the shares will be worthless meanwhile AAPL becomes first 1 2 then 3 trillion dollar company. AAPL at all time high. Now of course it’s the side loading crowd complaining the most. Just go buy Android phone, you will live.
