Local news is now stating that it was purely an accident (foot stuck on accelerator).

The driver had no connection to the store or employees.

A tragic accident (the driver will still face charges), let's hope they install some bollards.

Sounds like an accident. Hopefully they drop the charges. He’ll definitely get sued though.

Apparently he claims his foot got stuck on the accelerator, and he tried braking to no avail. He was driving a Toyota 4Runner - and Toyota has been subject to claims of stuck accelerators in the past:


I wonder what (if any) responsibility Toyota has in this crash?

Driver should still be charged because he could have just as easily steered his car into the brick wall next to the Apple store instead of hitting all of those customers and employees. So sad!

Probably depends on whether Toyota made the customer aware of the issue with a recall or not.

Thank you, that is a very good point. I agree with you - I just wish they'd quickly note a compassionate response as well to indicate that, but you're right - just because they don't, doesn't mean they don't care about the victims and the tragedy that unfolded.

I am very happy to know this isolated incident was not caused by a intoxicated Apple user.

Maybe just a poor choice of words or explanation (by him and/or the police or lawyers) but saying one's "foot got stuck on the accelerator" would be a different situation than the accelerator got stuck. I'm not sure how someone's foot gets stuck on an accelerator. Inappropriate footwear... walking through wet cement before getting in the car... ?? Even if someone's foot got "stuck" on the accelerator, it doesn't mean they have to push down on the accelerator.

Lots of questions/unknowns here. It will be interesting to see what the investigation reveals going forward.

Yea I was think maybe the footwear got caught under the brake. I think someone may have mentioned about a car manufacturer's floor mats getting caught on it too

Toyota prides itself on pre-owned cars.

The vehicle is a 2019 model 4Runner. Those are made in Japan. Did the accelerator issue affect Japan made vehicles also or only US made.

I've had my foot briefly get wedged between the brake and accelerator while wearing boots, causing the car to rush forward. Another time I was wearing flips flops and it twisted sideways and while braking so it mashed the accelerator. Both scary, but I was fortunately able to react before an accident. This one sounds odd, but we don't have too many details yet, so who knows?

There are so. Many. Ways. To stop a vehicle besides the brake pedal. How about shifting out of the drive gear? Or shutting it off?

I get that people panic, but he truth is that this guy has DUIs on his record. I don't believe for a second that his foot got stuck.
I read this morning that his blood has 0.0% alchohol, that that evidently wasn't the issue. I've had my foot briefly get wedged between the brake and accelerator while wearing work boots, causing the car to rush forward. Another time I was wearing flips flops and one twisted sideways and while braking so it mashed the accelerator. Another time a floor mat slid up and over the accelerator. (This is all over the course 40+ years of driving but it does happen.) All alarming, but I was fortunately able to react before an accident. This one sounds odd, but we don't have too many details yet, so who knows?

Its a tight parking lot and the straight way is probably 500-700ft. If, and I mean a HUGE if, his foot got stuck why was it floored. From the various pictures did anyone see skid marks?

Look at the below image, how did a SUV hitting the accelerator go from the right side of the lane going thru the parking lot, into the Apple store, that direction is considerable off to the left?

He should have in all rights drove into Burtons which is right in from of the lane you would utilize? That kinda implies he had lost control of the SUV before he got close to the Apple Store.

Seems a little suspect that it was merely an accident. Regardless, he is at fault unless they can point to a defect in the vehicle. You can't just accidentally run people over and not be guilty or you shouldn't be driving a car. Is this really the first place he thought was a good idea to drive into?

I will never forget the time when I was driving with new, clunky snow boots on, and as I took my foot off the gas to hit the break, my boot (size 13 + snow boot girth) got wedged in between the gas and the brake pedal, and I could not immediately unlodge it. In fact, as I was trying to unlodge it, my big boot hit the gas briefly and the vehicle accelerated before I was able to break free. I had to swerve not to hit another car. It was a flook, never happened before, but it was a terrifying few seconds - and sometimes, that's all it takes.

I know the area well including that shopping area. He may have had 500' to get up to speed; maybe 600 if he came from behind the store across the parking lot from apple. If not deliberate, where are the skid marks from attempted braking? Did those fail as well?
