Now I am curious. Can Masimo outlast Apple in legal battles? Epic failed. Could Apple just drag out the fight so long that Masimo runs out of money and relent?
As for blood oxygen sensor, it works in Australia and I tested out a few times. Rather unstable result.
In a sense it would be better for Apple to work out their own sensor some years later without the involving patents? Or Masimo can just renew patents to hurt Apple if Apple can’t figure out their own ones By 2028?
 
According to the article the patent (or the last of them that apply) expires in 2028.

Given how much whining there is on this forum about Apple's overpriced RAM and storage upgrades I'm surprised that Cook's unethical business practices are getting so much support.
Yeah Cook got more sponsored supports than just this one. I’m surprised so many people pay Apple money and also defend Apple no matter what at the same time.

This is just a terrible and uninformed take on the situation. It is more like Masimo asserting that Apple’s implementation of Masimo’s patented technology/process is poorly done/unreliable.

Masimo manufactures hospital grade pulse oximeters—not unreliable.
 
Why doesn’t Apple just tell American consumers they must buy an Apple Watch 9/AWU2 from outside of the country, but then Apple will ship it to one of their stores or directly to your doorstep. Americans could order it from the Canadian website or so. Or at the very least, it’s purchased then sent to a third party who then sends it to the American buyer. This is how Americans who owned teslas were able to buy the official non-Tesla charging adapter before third party options became available….Americans would ‘buy’ the charger on a South Korean website (Tesla only sold the chargers officially in South Korea and you needed a South Korean residence address to purchase it from the Tesla store). The South Korean person would then buy it for you and then once it arrived, they shipped it immediately to you…There’s ALWAYS a loophole somewhere .

That's not a loophole. Thats just a great way to get slapped with a fine for trying to dodge the ruling of the ITC.
 
I’m not picking a side in this fight because I have a Series 8 which is exempt, but those on here saying Apple should partner with someone else or come up with their own sensor completely forget the fiasco switching from Qualcomm modems to Intel modems. It was a nightmare for the user.

Masimo is trying to bring their own wearable to market. They claimed it would launch in 2023. It'd be hilarious if the patent expires before they're able to produce it.

Side note: I recently went to a local walk in clinic to get something to fight a cough and the device they used to take my pulse ox was identical to the O2 value on my Ultra. Seems pretty accurate.
Getting the same value one time is not the standard by which to make that judgment.
 
patent trolls are the worst
These guys arent patent trolls. Patent trolls pretty definitionally dont actually make products that could be infringed on. You may not agree that Apple is infringing, it’s possible the courts decided wrong, but Masimo does actually make products that use this tech and the suit doesnt appear to be in bad faith, they arent trolls.

And I assume Apple is still trying to invalidate the patents in question…
