Sorry guys, I've never filed a PP dispute before so if my question sounds dumb it's just my lack of knowledge.
Why would a person need to file a dispute if the company your ordered a product from gives you an instant refund the moment you ask for it?
What am I missing here? I thought a dispute would indicate a conflict between buyer and seller.
If Element is willing to refund charges why would there be a need for a dispute?

I think people here are so hard up for this case that they're waiting as long as possible in desperate hopes that their case will come. Since PP has a 45 day clause, seems like most people here are waiting until the last minute that they'll get an email stating their case has shipped. If not, they'll open a dispute to ensure, if anything, the process for getting their refund back begins. Basically, filing a dispute covers your bases.
Yeah, I get what you're saying. I just wonder if a bunch of unnecessary disputes would hurt Elements credibility with PP when it could just be avoided by calling them up and getting an instant credit on their PP acc.

Hardly seems like overkill. Some production updates and picture of actual product would warrant the extra wait time. Keeping paying customers in the dark about the status and consistently missing promise ship dates are definitely grounds for a dispute.
If it wasn't for this discussion thread, individuals would have already filed disputes. The only thing preventing that is the ability to talk it out with others in the same position.
Element Case has handled this whole thing wrong from the beginning. First, you manufacture a prototype. You test/modify the prototype and once ready, you go to production. If it comes back from production and passes all your tests you then you send a working model to a gadget blog and let them stir up some hype for your product. Once you've got some production build-up and can fulfill some orders, that's when you offer it for sale and accept people's money! Is this hard or am I missing something? For those that have paid and have nothing to show for it and can't get the company to answer some basic questions, I think they owe you something in addition to the case. Its not for the consumer to provide venture capital to the company making the product. They should refund everyone's money immediately and issue an announcement once they have a product to ship out and not just render pics posted on their website.

They must be too busy shipping all those cases....err, wait they haven't any apparently.
The other thing they could have done is pretty much what they are doing now, except the following
1. Instead of taking full price for the case, do preorders. Say $20 or something with balance due before final ship (or at least give people this option - I bet most would have gone ahead and paid in full anyway)
2. Communicate with people over Twitter or their site or heck, even come on here and explain the difficulties they were having, apologize for them, maybe post a sneak picture or two of production and keep going. I bet people would be mostly fine with all of this and might even be supposrtive of the time to get it right if they had done it that way.

If we don't file the charge back from Paypal or CC 45 days/vary from different bank but most are 60 days, then Paypal and CC can "TRY" to get the money back but they can't guarantee and you shouldn't count on it. If we want the money back for sure then we need to open the dispute case within those period.
If anyone pay beginning of July which most of us did, then on or before 8/15 we MUST open the dispute with Paypal or CC bank.
Lots of companies use Twitter and Facebook buddy, infact Element Case used it up until July 8th to promote this very "Vapor" case. Jeff Sasaki the owner of Element Case had time to sign into his Facebook to delete it, but not time to post a simple message about whats going on / wrong?

That's all people want (besides the case!) is some communication. How hard is it to post an update on a site or Twitter for crying out loud? It drives me crazy when people say they are too busy. Everyone is busy. Take two minutes, post an update and people will be mollified for awhile.
This company is basically a startup company running on venture capital provided by the preorders... everyday they operate they are burning through that very cash by buying (or wasting) materials, retooling machines, paying employees, living expenses, etc. If lots of people cancel their orders the last ones to cancel are going to be out of luck most likely because that cash has been spent. Thats the worry I think.
I know with the way that Element has handled this launch that I may still wait on my Vapor, but they have lost me as a long term customer forever. Not that they care, but I won't trust them again, unless they have product in hand and ready to go.
