Any sane judge would just toss that class action lawsuit out of the window, because there's a free fix and it's called iOS 7.

If FaceTime is so important for you, you should upgrade. Alternatively, if you absolutely can't stand iOS 7 you could just use Skype or Hangouts.

So there's a choice there and I don't see how your consumer rights might be violated. Whether iOS 7 is ugly or not is not up to courts to decide.
 
You're talking about contracts and policies that are in Apple's own personal interest, forced upon people through EULA-style sneakwrap licenses. The people complaining are talking about ethical behavior. If iOS 7 didn't suck so much, there'd be a lot fewer complaints here.
There's nothing unethical about it. When you buy an Apple device, you are purchasing a device that will be supported for as long as it is updated to the latest software. Nowhere does Apple agree to offer their support piecemeal- i.e. to give you a fix for this issue without all the other fixes and improvements that together are referred to as iOS 7. There is no ethical obligation to offer piecemeal updates either. As long as it is clear from the start how the device will be supported and the customer willingly buys it, nothing is unethical. In Apple's case, they have been VERY consistent in how they do this and all reasonably intelligent customers know it.

Personally, I despise that they changed the contact images for iOS7. It really sucks that I can't quickly glance down to see who's ringing my phone, guess i should just get some new iGlasses according to applfantards on this forum!

My 5s is getting old anyway, guess if I don't wait in line for the 6 the second it's announced, then I'm some sort of living in the past caveman by reasoning of the posters here.

It's great that all of you have the money to go buy the newest shiniest, but it's really sad you have such disgust for those that have a different value judgement than you, especially considering how far behind power curves apple hardware usually is.

Eh? Nobody here is saying go buy new hardware. Everyone is saying stop being stubborn about upgrading the software on your current current device when there are absolutely zero functional drawbacks, and it actually takes more effort and time to come on here and complain about upgrading than actually doing it and moving on.

The only people that this doesn't apply to are either those who have hardware not capable of upgrading to 7 (but they are covered anyway with 6.1.6) or those stuck in 6 due to the need for proprietary apps not compatible with 7 for some reason (like a company running its own suite of specialized apps deployed on its corporate networked iOS hardware) which is a very niche and limited number of individuals, if that kind of a group even exists.

Also interesting that you signed up now just to post this.

Apple isn't forcing anyone to update.. if you want to stick with iOS 6, go for it. However, to expect them to keep updating an old version because you don't want want to update.. is ridiculous. What happens when iOS 8 comes out or you need a new phone?? Enjoy your bugs, security issues, and old phone.

Even the 4s can't run iOS 7.1 well. It may be better than iOS 7, but it's still a far cry from the polish of iOS 6.

Thats the thing, there arent bugs. Why does a service that worked for the past 6 months just suddenly not work anymore? Apple is forcing people. If facetime didnt work on ANY device running iOS6, then it would be reasonable.

What if you don't have AppleCare?
 
If your devices can't be upgraded to iOS 7, chances are it doesn't support FaceTime anyway because there's no front facing cam, or at least this is true for the 3GS. So Apple is pretty much just telling you to update to iOS 7.

On one hand, people should just upgrade. On the other hand, Apple actually killed a functionality that your phone originally came with and you paid for. There could be a class action lawsuit here.

Apple didn't kill the feature. It had a finite lifetime. Certificates expire. Only those resisting to upgrade are affected. How is that a fault of Apple?

6 is still supported as long as you're on the latest point release
if you kept it at original release to jail break then it's your problem and apple has no duty to support you

Or as I said, people who don't like the changes. Don't break something that is feasibly fixable and force people to update to features that you don't like. I would love an app to fix my one annoyance with iOS 7 ie: the crappy, hard to see contact photos, hope 2 of my contacts aren't wearing the same color shirt, or I'm screwed I guess.

ANd I did sign up just now to post this because I only occasionally read the articles, mostly to see when the Mac mini will get upgraded to a Haswell Processor, you know the one that's been out over a year? I've only recently been reading the comments and some people are just vile, disgusting human beings with their disdain of those that don't march in lockstep.

Actually, I might add that my 5s battery life sucks after the last update, so yeah, there are reasons to not update.

As has been stated already, they're wasting their time. Apple's TOS for the iPhone clearly state that Step 1 of troubleshooting is to upgrade to the latest available software.

If your lawyers have time to go fishing on this instead of working actual billable cases you may want to be concerned...;)
 
I KNEW IT! It was planned all along...apple wants you to be in iOS 7.

Of course, why wouldn't they? It might be a bit of a shock to people, but we humans adapt to our environment beautifully. iOS 7 is still as beautifully designed from a user-experience standpoint. That never changed.
