The following is directly from Apple's Terms and conditions of the program (SUBJECT TO AVAILABILITY!!):
Upgrade Option
- Conditions for Upgrade Option. You may exercise your Upgrade Option to purchase a new eligible iPhone, subject to availability, under all of the following conditions:
Edit: As you can see, there was NO promise of a date or model!!! The same for the rest of us and that is exactly how it should have stayed. Some of them got exactly what they wanted. Others didn't! Just like the rest of us!
I don't see what's wrong with those terms. Of course they can't ever promise a model availability or date. But as I said in earlier comment, they wronged those people by placing them in a separate queue with much fewer inventory. Therefore, they are just trying to undo that now. Equal opportunity 🙂
