Terrible analogy....

Apple came up with the name, and they trade marked it. Period, end of conversation.

It is like Ford trying to name a car a Ford Camry. Just won't happen....

Terrible analogy.

It is like Ford trying to name a car a Ford Auto. Trademarking a generic shortened version of the name to describe the item.

First, you mean trademark it. Second, Apple wasn't the first to use the term App Store, Sage Networks registered for the same trademark for an online software rental service back in 1998. The only ones who can say if Apple will have a right to trademark is the judge in the review case, not you or me or anyone else.

I meant they have a right to attempt to trademark it. In theory, anyone can try whatever they want, and Apple seems to get a load of press everytime they try to legally protect their work. Apple does have a strong case to trademark the term, IMO, however, I am not in the profession of issuing trademarks, copyrights or patents, so, it is just my opinion.

In regards to the term being used as a common term, no one started using it with any regularity until Apple did, regardless of any current trademarks.

You make yourself look like you prefer calling names than taking a look at Microsoft's history.

I am not talking about tablets, I am talking about Windows 8.

Everyone knows that the iPad was the first good tablet.

Does that even matter? We're talking about the very concrete subject of Microsoft's history with Tablets. Is that a history of successes? (man, I don't think even Ballmer would try to argue about that)

No we are not, YOU are talking about the very concrete subject of Microsoft's history with Tablets.

But hey, you're practically asking for a retort here, so I'll take a shoot:
Yes, I heard that Microsoft Flight Simulator is even good. Or at least it was at some point in the past, don't know how is it now.

People like you give Apple users a bad name.

I used the term often with my Palm Pilot. That's one example that LONG predates Apple's usage.

This is too much.

I feel like it's just impossible to get through to some people.

Most of the people commenting haven't even read the thread.

The same people that probably run into a room and butt into a conversation without knowing what its about.

Mentally ill lunatics.

Damn Tea Party....Making it cool for "folks" to be ignorant and still feel like they are "entitled" to an opinion.

Didn't Microsoft have something called Windows Marketplace which came out in Vista and sold digital software? Fair enough it was just a web page but the concept is more or less the same. I just see this as an evolution of that.

As for the naming if the courts say the term App Store can't be copyrighted then Microsoft have every right to use it.

They had the Windows Marketplace, followed by the Windows Live Marketplace.

Your statement has nothing to do with mine. I really don't understand why you are quoting me. Maybe you meant to quote someone else?

But you did accidentally accomplish the feat of making me realize anything I mention here will be seen as trolling, or will help exacerbate it, and I do not wish to be a part of such shenanigans.

Carry on good people.

*sigh* Apple fanboys blindly believing Apple invented App stores. Linux had these in 2000-2002. I remember installing Mandrake, Redhat etc. and having sources of software I could get.

Keep believing that Apple invented App stores. Even Microsoft had an app store on their sidekick in 2001 or 2002 called Download Catalog.

Trade Marks are not a claim of invention.

Oh my god... Windows 8 looks like a completely new OS. Where is the windows button? The wallpaper? What's going on? And way too colourful for my taste.

Looks like i'll be sticking with Windows 7!

Check this Windows 8 preview, it demonstrates pretty well where Windows is going - and it isn't so dramatic as that screenshot makes one think.

It's actually pretty conservative and in some ways the best of both worlds. In other words, if one doesn't like the "touch" interface, one never needs to see it.

I actually like the new GUI, just from the looks of it. Maybe using it won't be as easy, though. I have an Acer at home that is a touch screen, so, maybe the touch interface might come in handy. I'm curious as to what the non-touch sensitive part will look like...

You idiots that think "fanboys" are mad because Microsoft is copying something Apple invented are wrong. Apple didn't invent app stores. What I think Apple "fanboys" are mad about...at least this fanboy is...is that once again PC fanboys make fun of an Apple product and then support it when Microsoft starts copying it. iPhone is stupid without a real keyboard...now most android phones look like an iPhone. iPad is just a big iPhone and is useless...then we get tablets from every PC maker. App Store is stupid and 3rd party developers won't support it...now we have an app store coming in Windows.

I hope Microsoft will use the term "App Store" for its, well, for its App Store. Apple does not deserve any rights on this. App Store is short for Application Store, Apple does need to be educated on this.

Speaking of educating... Microsoft is contesting the grant of trademark.... but right now Everyone knows Apple has a trademark on the term "app store" right?

----------

I can see it happening already.

"iOS features were added to Lion, in preparation of the next generation, cross platform, Apple OS, therefore Microsoft copied Apple"

Lion has already implemented iOS features. People are kinda complaining about it now (trackpad direction).

Apple lost such a strong case when their CEO used the word in a descriptive and generic fashion during their earning's call :

http://www.businessinsider.com/amazon-steve-jobs-referred-to-app-stores-2011-4

This has already been discussed at length, maybe you should go read the threads about this topic, it is quite irrelevant to this thread.

I didn't start the topic...just commented on it...in any event, I'm way past it. I was just adding my .02

I happen to like the gesture features on the track pad. Makes navigating my MBP very easy.

lol, Windows 8 :D

Yeah.

I did find it extremely annoying that Microsoft announced Windows 8 a couple of weeks after Windows 7 went on sale.

Why would anyone buy software when the company announces a new one at the same time?

But, going off point, I think Microsoft is testing the waters by releasing plans for Windows 8, that way they can gauge feedback, because right now, Windows 8 is just vaporware, right? It will probably be years and years before there is a Windows 8.

Hmmm...i wonder where they got that idea? Probably not from Apple, its just a coincidence...you can patent "App store", so that must mean that if Microsft opens a App store with Windows 8 is cannot possible be influenced by Apple..
