Talked to my lawyer about this, and he said this WILL probably pass, EFF will fail to convince the lawmakers that jailbreak is not illegal.

I'm still putting all my money on Jailbreak becoming legal. I want to do that. Now, whoever is calling me a fud, get the f- out of my life, or buy a PC  you PC lover.

Wow. If you really do have a lawyer (why does a college student need a lawyer anyways?), you should probably start the hunt for new legal counsel, because he's either an idiot or thinks you're one.

This isn't a bill we're talking about -- there is nothing to "pass". There are two possible scenarios at this point:

1) The EFF's request for a DMCA exemption is granted. In this event, a DMCA exemption is made to explicitly allow (among other things) software that circumvents a content protection measure for the purposes of enabling "wireless telephone handsets to execute lawfully obtained software applications, where the circumvention is accomplished for the sole purpose of enabling interoperability of such applications with computer programs on the telephone handset." This is can cover jailbreaking, but can just as easily cover, say, the modification of firmware on a Nokia phone.

2) The EFF's request for a DMCA exemption is denied (as a result of Apple's comment or otherwise.) In this event, nothing changes.

Read #2 again, Kento. If the EFF's request is denied, nothing changes. Jailbreaking is not suddenly "made illegal." This is not a trial -- if the EFF fails to convince the Copyright Office to exempt the first of their two proposed classes of works, then it does not establish any legal precedent of jailbreaking being illegal. It might make it easier to argue a case against, say, the Dev. Team (although probably not *that* much easier) on the grounds that they are distributing a tool that could be used for the circumvention of an access protection measure, but the denial of the EFF's request will simply mean that the status quo remains. That's it. Jailbreaking will still be in the legal grey area that it is now; it won't be explicitly illegal, but it won't be explicitly legal either.

Now IANAL, but I'd say that the EFF has a good shot at getting both classes of works exempted. There's a bit of precedent for allowing reverse-engineering, etc. to allow interoperability, and it's pretty easy to make a case that jailbreaking helps make the iPhone/iPod touch more interoperable with other devices/software. (Of course that interoperability is precisely the reason that Apple *doesn't* want an explicit exemption, as it would undermine their ability to lock the device to the Mac OS X/iTunes ecosystems...) As for the second proposed class: the fair use provisions of existing copyright law seem to make this one obvious. Now whether or not the Copyright Office will think it's obvious I can't say, but I'd hope they see it as a natural extension of the fair use provisions of the laws that are already on the books.

Oh, and I'm not calling you a FUD. I'm calling your posts FUD. There's a slight difference. I took your advice though: I've recently added a ThinkPad X61s to my collection of laptops (which include an iBook G3 and a MacBook.) I wouldn't call myself a PC lover though... they're not really my type, plus I get the feeling that they'd just stay with me for my code and not love me for who I am. :(

If AT&T "brings out the tethering" are you willing to pay an extra $30 a month for something you "might" use every once in a while if your broadband goes down? I'm confused.

I am in India and there are no additional charges for tethering, anyways the plans are more expensive and i have subscribed to it

So my answer is yes i would love to have it and the phone is sold all over the world now, so please give us a break AT&T!

I just restored my iPhone again. It was jailbroken just to change 1 sound and 1 icon... I figured it wasn't worth compromising my iPhone for a couple of minor edits. I restored and I'm just going to live with the icons the way they are... *sigh*....

Welcome back brother;)

you guys are acting like jailbreaking is a sin, if you are that loyal to apple (and Im sure they dont give a crap about you) then sure, dont jailbreak it, but for us who want to customize our phone to fit our style and still having the option to go back to normal, dont knock us

For me... I didn't go back because I'm whipped by Apple.... I went back because jailbreaking doesn't really fit my needs. I'm glad you like jailbreaking and you're fine with that. I guess jailbreaking just isn't my cup of tea anymore.

OrangeDog: You're too funny.

I installed 2.2.1 and left it un-jailbroken for abotu 15 minutes, that was about all i could take of not having my toys.

I don't think there has been one post knocking others for jailbreaking in this entire thread. I also don't feel anything to Apple. I don't want to JB because for me, it turns *my* iPhone from a smartphone into a dumbphone.

Are you removing features after jailbreaking?

I hope all four of your pages aren't that full...

Doesn't that hurt your eyes? Even a little??

No, only the home page is that full

The completed home screen is set up by the row being a catergory and usage.

Since I hold the phone with my left hand the most frequently used apps are on the outer right side of the screen and in the dock.

It works for me.

Thanks Spaz I am glad you dislike it. j/k

Clever. So do you even have apps on other pages?

I'm not against jailbreaking and I'm not scared to do it and just because I'm running stock doesn't mean I'm Apple's b-word.

I'd love for my iPhone to be jailbroken permanently. I've JB'n it more times than I can remember, but I can't handle the lag slowdown and bugginess that is inherent everytime I JB it.

Two things that mainly bug me with a JB iPhone is the lag and the usage meter doesn't work.

A non JB'n iPhone is super responsive and a pleasure to use. I do like the extra functionality that JB'ing offers as well as the extra level of geekiness, but the trade off in speed and bugginess aren't worth it for me.

yeah, games are on page 2
jailbroked apps like system, backgrounder, finder, and terminal
fourth page is all the stock apps that have been replaced by third party apps and others.

Exactly. By the way.. the usage meter stops working if you restart the SpringBoard or restart the iPhone without turning Airplane Mode on first.

Yeah. Take the same exact phone you have, and:

add cross-application Copy & Paste
add decent on-the-fly Video Recording
add the ability to move files on and off of it easily by having it pop up as a shared drive in finder
add being able to save any file type to disk in safari
add being able to attach any file on your device to an email and send it out
add full user control over your interface

That's dumb. Why would anyone every possibly want to do those things?

Exactly. By the way.. the usage meter stops working if you restart the SpringBoard or restart the iPhone without turning Airplane Mode on first.

Hahaha... Yea, Jailbreaking doesn't do anything to the usage meter. It gives you the option to respring if you want. That will reset it though. Same thing if you plug your phone into a computer.

As for lag... If you don't install Winterboard... there is none. Mine runs just as fast. But... I'm not gong to try and convince anyone otherwise. If you have a use for the other apps that Apple wouldn't let into the App Store, then you'll do it. If you have no use. Then you won't.
