I'm amazed that nobody understands that ok go is feeling a little pissed off.
Sueing is no point on the other hand
 
Shouldn't OK Go sue the production company, or maybe they didn't have an agreement in place where they couldn't accept another client with the same idea. I fail to see how Apple is at fault here.
 
Free publicity, and pretty embarrassing for OK GO, they should be flattered that Apple used similar concept.

The legal action in the country (US) is astonishing. I work for a massive Japanese company and our executives overseas constantly ask why there are so many law suits in the states. You can practically sue for anything, it's almost like gambling, most settle because it's usually less than the cost of dragging litigation.

Does no one remember the brouhaha between Apple and The Postal Service, over Apple's promo commercial for the switch to Intel on Macs?

Apple hired the same director and did shot for shot recreations of The Postal Service's video. Perhaps more eggregious in that case, but not that different than this one.

Apple ripped off no one. As others have commented, this optical illusion of forced perspective is nothing new. OK Go has no claim to it.

The very fact that Apple hired the same PR firm and director speaks to the fact that those people realize that this is not a technique that is original to the band; rather it is a tool, and this PR firm and director are good at using it.

In fact, in the music industry, it is not uncommon for directors and producers to have a hit video or song with one artist, and then another artist employ that same director/producer to do something similar for them.

So OK Go couldn't in any way prove they have any rights to use this concept. All Apple lawyers would have to do is show several videos from YouTube showing similar forced perspective.

But then there's the issue of damages. OK Go would have to prove that this in some way harmed them. But as we know that is absurd. Far from being harmed, OK Go is benefiting from the renewed publicity for its own video.

Apple didn't even profit from this video. It's not being sold. It is not being used as a stand alone ad on TV, and in fact, it advertises no specific product. It's more a statement about Apple. There's no way to say that Apple made any specific amount of money by using this video at its keynote.

OK Go has no legal case and they know it; they are using this for publicity.
 
Good luck in court! If the video is from the same director and the same production company the judge will laugh and send them back to rehearse at the studio... The original idea must have come from the director so it is not appropriated or in infringement of anything but his own reputation...
 
When I watched the Apple clip yesterday I thought 'oh, they must have collaborated with the guys from OK Go'...I can understand that they're upset.

Not sure it really matters. Let's be honest, the OK Go video will get tonnes of hits now, which can only win them audience and hopefully money.

Not too sure about that. This OK GO band is like the free samples of Uncle Joe's sausage at Costco; once tried, I won't be buying....ever. Crap band.

Plus, I've seen this kind of thing all over the place. Even in my home town of Cardiff, there's a massive water barrage with these kinda "stand in place" patterns. It's definitely not new.

If the band's main vocation (music) is complete rip-off pop fluff, why would anyone believe for a second the had an original idea for a music video?


Anyway… just wasted 2.5 minutes of my life watching the Apple gaff. Boring promo stuff.

Was just about to say the same thing about watching the "OK Go" video. Combined we should ask for 5 mins back.

They have really cool music videos if nothing else, but yeah this is nothing more than being inspired by a similar idea, which happens all the freaking time. They're obviously just making a stink about it for the attention.

Yep they stole the idea. Apple's isn't done as well and isn't even real as it is clearly a 3D animation but you can't own a concept like that so OK Go will have to give up on that claim.

OK Go did not invent forced perspective.

Apple copy something? Never! I won't hear a word of it.

I mean when it's the other way around I care immensely. Say if Samsung copied something Apple did. Then I'd care.

There is no case here because of the two videos, one is clearly made by a bunch of self-interested, pretentious, corporate sell-outs, and the other is a fun music video.
 
Why not sue OK GO because they "obviously" stole Apple's "Think Different" campaign...WTF, it seems you can patent anything?
 
Absolutely an absurd claim. I know ok go is a "band" who only exists because of their music videos and not because of their music but this complaint is baseless even if some of the same camera tricks are used. The videos are not all alike and ok-go does not magically own the rights to how a camera moves.
 
Hm, well, it sure does look like Apple (or their ad company) probably saw the music video and say, "That! That's how we'll do the Apple Message Ad!"

But so what?

I'm not really expecting that ads necessarily need to break new ground with a purely original concept every time. Good music videos aspire to that, but it's just an ad.

OK Go manager Andy Gershon claims the band met with Apple to discuss the concept for its music video in hopes that Apple would collaborate on the project.

This part doesn't really make sense. What the heck would they collaborate on? How would Apple contribute to a music video collaboration? If they are talking about ads, why would Apple hire OK Go to help them make an ad?

I guess this is about $$$. Maybe OK Go wanted to Apple to pay them $$$ for some kind of tie-in with their video but Apple hired someone else instead. I think I'd feel worse for OK Go, but I've seen this concept before. So what did OK Go really have to offer?

On point, I watched both videos and sure they are similar but I don't think this is worthy of suing over...
