Palm pre has flash which is 90% of web content.

Umm, no it doesn't. Flash didn't make the cut for the first release although they say an update will have it.

From the CNET Review:
Also, there's no Flash support at this time, so you can't view Flash videos within the browser. However, Palm announced its commitment to Adobe's Open Screen Project back in February and promised to bring the Flash 10 Player to its WebOS devices by the end of the year.

I shouldn't be forced to buy an iPod or an iPhone just to have iTunes syncing.

Why? Because that's what you want. Apple's software. If Apple decides you can only sync Apple devices with iTunes, that is the way it is. No one says you have to use iTunes.

No different that gaming devices. Software is routinely tied to specific hardware.

Yes everyone wants everything to work with everything else. But there would be no innovation in the long term because a company would never be able to make money from what they do for fear of another company using said innovation to glean market share.

I think apple would be happy it can sync to the Pre. They make more money in the long run from people buying content from their store than the devices.

But Apple makes its money on the device not the content. Apple probably makes something like 5-15% profit on any of the content it sells through the iTunes store after everything is said and done. Apple's main profit is from the hardware, 30-65%.

Hey guys just got home with my pre and had a quick question. If I plug it in and sync with my iTunes am I violating my macrumors terms of service? I'd like to have all of my music and ripped movies, but I don't want to miss my daily dose of angry sarcasm that I get from macrumors these days.

What should I do? I'm posting this from my Mac just incase it's also against the rules to browse and post from my Pre.

(it's probably necessary to note)</sarc>

P.S. Someone please quote me and only reply with the rolleyes smiley. That'll teach me a lesson.

Being snotty hardly defends your argument.

This coming from someone with a signature like yours... :p

Point of order: Apple paid Xerox with Stock options for the right to use their GUI stuff, the mouse, etc. That's a completely different situation than what is happening here.

Still, Xerox invented it so they have the credit for it. Don't see any mac-fannies blitzing over that one... :D

I'm sure there are more examples where Apple gladly used a loophole for their own purposes. After all it's just corporate strategy.

DMCA says:

"(2) Notwithstanding the provisions of subsections (a)(2) and (b), a person may develop and employ technological means to circumvent a technological measure, or to circumvent protection afforded by a technological measure, in order to enable the identification and analysis under paragraph (1), or for the purpose of enabling interoperability of an independently created computer program with other programs, if such means are necessary to achieve such interoperability, to the extent that doing so does not constitute infringement under this title."

If Apple decides you have to paint yourself yellow to sync your devices with iTunes, would you have a problem with that? :D

Please understand that Apple is a business and they can't do whatever they want. Not even Microsoft can do that type of tying.

Case closed.

A person is not a company.

I cannot see anything that says that Apple is not within its rights to stop this with future updates.

What the hell are you talking about? I just wouldn't update to the paint-yourself-yellow version of iTunes. Buffoonery!

I'm not saying Apple can do anything but I do believe companies, as well as individuals, have the right to protect and safe-guard proprietary software and other technologies.

AMEN. Thank you.

Seriously it sickens me how blind and robotic some of these fanboys are. I LOVE Apple myself but even I don't see a point in making iTunes "iPod/iPhone only". It reeks of elitism - Like they think to themselves, "Ha! You bought an MP3 player that isn't Apple? **** YOU!"

That's so immature and selfish.

I myself am very happy to have iPhone for the forseeable future but my hubby is a Nokia fan & other members of my family have various makes & models. I would love to be able to sync them with itunes. Its so easy & straightfoward to use.

Why doesnt Apple allow it???
& where is the list of mobiles that ARE currently allowed?

Apple doesn't allow it because one-touch iTunes syncing is a selling point of the iPhone/iPod. They make very little on iTunes store sales - the profit is in the hardware. And by keeping a desireable feature like one-touch syncing to their own hardware, they sell more of it.

Honestly, I don't much care what apple does about this, but I can't see why they *wouldn't* break this. Why would they allow a competitor to piggyback on their selling point?

The tech press is just like the political press. Always trying to set up some controversy. Consumers will vote with their dollars. 11 people at Sprint's flagship store to get the Pre? That speaks for itself.

Bah, who knows, it might catch on nicely. Although "gradual growth" and "eventual adoption" is not a good way to go considering the circumstances. Palm needs this to be a runaway, blowout, blazing success. This thing has to excite.

I have one friend who picked one up this morning. He's a Sprint nut who's been waiting for a decent phone on their network. My others friends who are in the market are waiting to see what news Monday brings.

Agree that Palm needs to hit it out of the park with this launch.

Oh boy, with that user storm Apple better hurry to stop Palm fast or they're going to go bankrupt for sure! iTunes/iPod is doomed now!

Seriously, this is what all the Mac-fannies is getting so hot over... :D

Well from what I'm reading on the news, the crowds are pretty small, but they're excited enough.

The problem is that the Pre is being labelled the 'iPhone Killer" everywhere. Usually not a lucky title. But who knows, this might be "the one." Hehe, it should have been dubbed "The One", a la Matrix. It mght have been a nice marketing move.

First off Apple does have the right to stop it if they want to :( they made iTunes and they make the updates :p

Secondly I can almost guarantee that they will block it  or a slight chance of letting them pay rights to use iTunes (pay through the nose) :D , because if they don't stop them, that means that other companies are going to do the same thing and make cheaper products which would directly impact the sales of the iPod and iPhone.

Face it Apple is a company, :) and they are doing business to make a profit. :apple: Just because you, as a customer, want the ease of use of their products and don't want to pay their prices, doesn't mean that Apple has to let another company make a profit off of their hard work.

Eventually someone will get it right but that's only natural evolution of things. Until then we're stuck with all the obsessing over the iPhone's type of plastic and what not.

Spoofing another company's device ID is illegal according to the USB consortium.

So now the USB consortium is also writing laws? Some of you folks around here don't have the slightest clue of what the word "illegal" means, but you throw it into every discussion nonetheless.

It's time you start realizing that corporations are not countries, and that CEOs are no kings... Or gods. And that not everything they tell you is the truth and that not everything they do is legal just because they put it in an EULA. Or a specification. And here's another news flash: Just because you get a patent on something that doesn't mean that the patent is valid. Not in other countries and not even in the corporate-friendly United States. When you folks go and look up the word "illegal", also try looking up "prior art".

No, they don't. It would be anti-competitive and ILLEGAL. Microsoft was hit hard with a huge legal sledgehammer when they put code into Windows 3.0 so that it would not run well with DR DOS and eventually Microsoft had to pay for it. The very same would happen to Apple.

:D:D:D:D

Do you have a shred of evidence to back this up? It is not illegal for Apple to release an update that breaks the Pre's ability to sync on Apple' OWN software. They don't even legally have to support iTunes, they could scrap it all tomorrow.

This is interesting (the reason is obvious [why WOULD Sprint tell people and then watch them leave their store??], but it's still interesting.)

I arrived at the local Sprint store at 10 this morning, and waited in line for over half an hour.

When I finally reached the counter, I was told “We actually don’t have any more, but we can ship when they become avail…”
I interrupted and asked why they did not tell all the people waiting in line that. I was told…”We aren’t allowed to say that.” They aren’t allowed to say that to the people waiting?

I did the other people in line a favor, loudly saying “They don’t have any more Pres, and they won’t tell you that.” as I left. The entire line left as well.

I am going to switch and get an iPhone, something I should have done years ago. GOODBYE, Sprint. This is not how you treat a customer of over a decade!
