This is really just laughable by the samsung lawyers. Hey Apple it's samsung the guys that you keep in business because you by some much of our tech components, the company that directly copied your phones and tablets; would you mind giving us your unannounced, unconfirmed, and original designs so that we may copy them? This way when we release them at the same time it will look like we have come up with the ideas at the same time Brilliant!!

Apple was only 2.6% of samsung's total sales in 2010 Q1. Believe it or not, apple needs samsung as much as samsung needs apple.

Because R&D is a process which requires a certain unknown amount of time from start to finish, there will always be overlap between the various competitors products.

Because R&D is done by humans, there will always be similarities in some aspect of the project, and complete difference in others. Especially when designing when designing something that must include identical functionality such as a mobile phone. IE: phone calls.

Therefore I have never had the desire to make an all encompassing claim such as "Android killer" or "iPhone killer". Nor do I have a desire to declare one device superior over the other.

So what is my point? It's that competition and difference is something I enjoy. Just like discussion of pro's and cons is of interest and far more productive than being defensive, angry, and using the deliberate tactic of name calling and insults against others.

In my personal experience, I'd much rather learn and grow instead of acting foolish by fighting. Also I don't agree "It's the Internet", since arguments are as old as time. Why not replace the chaos with meaningful discussion. Appreciate there is more than just one "right way" and make the forum more enjoyable for all.

:) Very smart well thought out post. I feel exactly the same. I don't understand why people declare unwavering allegiance to a brand or operating system, like they think the company will reward them for they're loyalty. It's best to try everything and find the device that works best for you. The "killer" phones are going to be topped in a few months anyway.

The question is one of degree.

If the overlap is too much, then the offended party is allowed (sometimes required) to act according to legal means available. If a court finds they have cause and grants them damages or restitution or some form of enrichment or compensation, then the overlap was egregious, possibly deliberate.

It's lovely to talk about R&D and natural human foibles, but Intellectual Property is still property.

This isn't sharing-time when you go back to your mat with the other kids in kindergarten. There are billions of dollars at stake here, brand integrity, and of course, limits set by law.

HTC and Samsung also offer very high end phones which are superior to the ageing iphone, such as the Sensation and Galaxy 2.

I really hope these lawsuits aren't just because Apple is suddenly finding out it can't keep up. We'll see when they introduce iOS 5.0 and the next iPhone revision I guess.

Every time around this time of year, the Android options get more tempting, and Apple always comes through. Regardless the only thing to offer with Android that would really sway me is a larger screen on my phone. However my iPad handles those duties nicely, so I'm taking a wait and see approach.

My husband's Thunderbolt with 4.3" screen is amazing (and blazingly fast with real 4G/LTE on Verizon), but a slightly larger AMOLED screen would be great!

Oh wait - this one's AT&T. Don't they sell another, last generation, smartphone with a smaller screen, no 4G, and warnings about how not to hold the phone to avoid shorting out the antennae?

I understand that touchscreen-only phones are the in thing right now, but I hope when the G3 rolls around (if it does I suppose...) that it has a hardware keyboard. I type so much better on that than on a virtual one.
 
It is disturbing how Samsung so blatantly copied Apple. Hopefully they will continue making good parts for ipads and drop their futile attempt to get into the tablet business.
 
Apple is trying to embarrass Samsung. Samsung is responding in kind. I have no issue with this. Samsung's phones and OS might look a bit similar to Apple's, but in no way do I condone Apple's stick-up-their-ass legal practices. I respect Apple's right to "protect" their IP, but bullying their competitors is not the way to do it.

You don't know much about Samsung, do you? If you did, you'd be saying 'turn about is fair play'.

Android looks appealing until you consider the growing amount of malware on the platform. It has grown by 400% already.

And that is Samsung tech, not Samsung as a conglomeration. As the latter, Samsung are many many many many times larger than Apple.

Ah the decennial malware on OS X. It always makes a splash in the news because it is so unusual. Enjoy it while it lasts.

400% increase in malware on the android OS in 6 months time though. I realize it is fun battling that but I don't have the time.

I think Android will be like Windows. You can use it without fear of malware if you are smart about it. Th problem is that those platforms have a large number of users who are not smart enough to avoid the malware and that puts everyone at risk.

I won't "enjoy it", because naïve users will have their money and perhaps identities stolen by Mac Defender and its clones.

I will enjoy, however, no longer having to read posts from smug (and clueless) Apple fans talking about "UNIX security" and other nonsense. Look up "Maginot Line" to understand what I mean.

Well I guess if it is that easy to put malware out for macs then it must be there. I guess the reason it doesn't spread is that the average mac user is smart enough to avoid it.

Flash compatiblity still matters. What MS own test show that Safari does the worse at with HTML5 proves big time that HTML5 is not ready for prime time. It has a long ways to go. Apple little testing things prove it as well. So much is out there and it HTML5 works in a very limited format on any given browser. Flash still rules the web.

Malware on iOS didn't increase by 400%. But it did on android.

You don't understand the numbers. That is all.

Only to people looking for a talking point against apple. According to the people who think it matters, lack of flash compatibility should be a death knell for to the ipad.

Apple OSX has superb defenses for attacks coming from the east. The enemy, however, is coming from the north.

You see comparing iOS and android, it is recognized they are relatively new OS and so 400% or 100% means something different than the same percent on an OS that already has large amounts of malware. Comparing percentages for iOS and android right now is fine. The magnitude of the percent doesn't mean a thing. 400% growth on android is much greater than the growth on iOS currently. But comparing windows and Mac OS percent would not be applicable because Windows has so many more viruses that a large growth is a small percent. So saying Mac OS has a much larger percent growth in malware than windows would not make sense.

But right now it is alright to compare percents on the mobile numbers because they are all just getting started.

Now at the rate things are going, it won' be long before the percentage comparison no longer holds as android will have so much malware compared to iOS that it would take a much larger increase to on android to equal the percent in increase on iOS. But for right now it is Ok.

in any event you an use percent or raw numbers. Malware is growing on android much faster than on iOS. Got it?

I'm doing no such thing. I listed on story outlining 50 pieces of malware at once. Recently Google puled another 21 malware apps in one go.

I always know the opposition is reaching when they start attacking me (back pedaling) instead o the topic.

So it is decided. I am right. There is more malware on android and it is growing at a faster rate.

Hint: There wasn't one. No one cared. The iMac created a rush on USB peripherals which found its way into the PC market.

You forget that it takes up to two years to develop new Hardware. So if shortly after the iMac USB devices apperard they have been in development long before.

As such I a with the OP: USB was coming before the iMac.

Not even a little. Every one of the phones you showed there have physical keypads and/or keyboards.

Correction: Optionally had physical keypads and/or keyboards. They where fully functional without. That is why I made the effort to find pictures without.

They also all utilized resistive screens with a stylus.

We already had that: capacitive was just to expensive at the time.

And Stylus is independent of touch technology. There are capacitive styluses and resistive touch screens work with fingers just as well.

Resistive has nothing to do with finger touch - the screen size has. Sony Ericsson was a bit cheap on screen size. Unlike Apple 3.5 inch (9 cm) was pretty large for the time.
