this is interesting from another thread:
On a new iPad I don't believe the option (on/off) shows up until you actually install the smart cover for the first. If you don't have a smart cover you could try to use a magnet to activate

I used a magnet to see if it was the ipad or the case. It is def the case. I hope speck releases one soon.
I trie this with no luck. I have the tarsus Versavue and decided to chat with them online about the issue especially considering it clearly states "magnetic on/off" on the packaging. Bottom line - they are working on the issue and asked me to wait until Monday for a solution!! Their product development team is working on tis issue whatever that means.
Bottom line - rushed to market to tai advantage of the launch. As an aside if I push down on the edge with the magnet I can get it to work but thats hardly a long term solution and it appears to me the magnets are not powerful enough to pull down the cover and activate sleep.
I had a gray case from Best Buy and magnets didn't work. I got a red one from Amazon and the magnets work
The only choice they have is to send everyone new cases or refund a sizable portion of the money. This should not happen for a $50 case and I'll bet someone at targus is not sleeping well tonight. Esp since they marked the box as such. Mine works well. And I don't care about the on off feature. Mine auto locks in 2 min anyway. I like the case but will be interested to see what they do...possibility of some non ferrous strip magnetic tape would work while waiting...
I'm really not worried about what they do to fix this. I am just annoyed I waited for a "3rd generation" case and they obviously rushed this. Online chat was like " what don't you just wait until Monday until we see what we can do?" thats not acceptable. Back to BB with both cases I bought and get another which I will test before leaving the store. really tired of these company jumping on the back of a new product launch without testing their products.
Going to keep my Grey Slim case for now; I don't have a spare case to use at the moment. The video from chukronos is spot on though, it is exactly what I am experiencing.

I started to get the Slim case but changed my mind and went with a Vuscape. So far it's been working. I have a Lexington ordered as well so if it stops I'll return and use that one when it comes in. Too bad. I do like the case though as far as looks and size.

I returned mine after finding the sleep wake function didn't work. Way to much money for it not to work.
So I received my Targus Slim Case in white and I love the case except the fact that as many others have found, the magnets are not working. Also I agree the tab on the back is not that good. Unfortunately I just don't feel it's worth $50. Not when something like the Lexington is only $40. So now I'm looking for a similar solution.
I do think it's maybe 10 dollars high but I'm not so down on it as everybody else. My magnets work - every time - and I like the color, it's the right heft, the stitching/material is sturdy and the pad clicks into place. All the controls and holes are in the right place, including the cam hole. I'll keep it. Got a white one coming for wife...

I think it's arguably the best looking slim iPad case. I just wish my magnets worked.
My gray one from Amazon just arrived. The wake/sleep function does not work properly. Just carrying the case around the house randomly activates the wake/sleep. Obviously a no-go.

Ordered two from Amazon and recieved the bone white one. I have no issues with the case including the magnets which are working the way they should. My red one has not arrived yet but I will test that it once it arrives.
