Only an idiot would confuse the two with the BIG SAMSUNG on the freakin front.

You're saying Samsung's lawyers are idiots?

Apart from that, I never went back to an ipod because:

-forced use of itunes
-no removable battery
-no way to retrieve music or other files from the device from other computers
-no custom 3 or 5 band equalizer settings
-piss poor battery life regardless of new or used
-awful sound quality (not even debatable, its been proved that apple's SQ is the worst)
-no support for other formats (ogg, flac, etc)

1. Most people are quite happy with iTunes. At least Mac users.
2. I replaced the battery in my iPod Mini, and the one in my iPod Nano is just fine after two years.
3. Ever heard of iTunes Home Sharing?
4.
5. My two year old iPod plays for 20 hours without problems.
6. Nonsense. Get yourself some decent headphones.
7. Who cares about ogg? Who cares about flac? And what format is "etc"?

A few facts to keep in mind while discussing this case. First, this is not about patents, or trademark or trade dress. This is about Community Design, a European equivalent to the US design patent.

Next, the ban is not over how the Tabs look like the iPad at all. The Judge did not factor this in his decision. This is strictly about the Community Design registration 181607 assigned to Apple in 2004 :

Finally, it's of note that this same community design registration (# 607) was found as not applicable by another European court, the Dutch one :

The Dutch court ruled on the basis that the design was too plain to be upheld and that it wouldn't survive an actual court case in all probability. The German court ruled on the basis that the design was plain valid (they didn't question it) and thus granted an injunction.

So frankly, anyone using the German case as the basis of their opinion while ignoring the Dutch case altogether is quite biased. For now, no one is a clear winner in all of this and all of us consumers are losing big time.

How about wasting valuable court time with frivolous lawsuits. It's like the convicts in prison filing lawsuit after lawsuit.

As I've shown and explained Germany's courts are busy with far more frivolous lawsuits than this. they have a whole industry (auto, industrial, lighting) to deal with. They are based in one of the world's largest patent generators.

In recent events there's for example the enormous battle of the LED lights between Osram, LG and Samsung. A couple of months ago this led to LG and Samsung demanding an import ban to Korea of any German car that used those LEDs - this included Audi and BMW.

You may think this tablet battle is very big, but it's really nothing. It just gets super widely reported because Apple is involved and the media "loves" any Apple story.

Apple doesn't own colors and shapes, sorry. This is a frivolous lawsuit.

..seriously this is like one maker of dinner plates suing another over the shape of the plate.

I sometimes wonder WHY Apple is after Samsung because there are several other manufacturers that look similar to the iPad they aren't going sued.

Too many things actually, same look, same packaging, same USB wall plugin recharger.

Its not even the looks are the same, just look at the hardware: forward & back facing camera, accelerometer, gyroscope, might as well say iPad clone.

Samsung has always known as a clone company, looking at its past with its blackberry clones and iphone clones ect.

The courts have sided with Apple so far. If you have a case there's no frivolity. Apparently there's been some wrongdoing by Samsung. Further, it's a situation that will ultimately clarify everyone's position re patents.

...

I just bought a galaxy 10.1 for $199 on a special deal and am excited to get it. Sold my iPad 2 to get an air and now I will have this too

Yeah, life is hard, pal. You think it was easy for Apple to produce the iPad. Think they just pulled it out of their butts? Think again.

You deadbeats obviously have no clue what it takes to create something of real value.

You bet it's HARD to make something as good as an iPad, which is what these other companies are finding out.

Yah, i looks really tough...

Which is the genius of the whole thing.

Remember that the iPad is based on the design and ecosystem of what was already there. That was years of work.

Just sayin... when you have design language and partners like foxconn... you can churn out almost anything with little effort... why do you think the mac pro looks the same after... how many years....?? if its not broke... dont spend the money to fix it.

I didn't know that. Thanks for the info.

Well Apple certainly feels that there was wrong doing by Samsung. What I don't get is the rectangular shape with a black bezel infringement. Most tires are black and round, whether they are made by Goodyear, Michelin, Pirelli, etc.

That's about what it took to design it.

That's ok, don't worry your head over it. Leave it to the courts and those who are paid to "get it."

Sure let's talk some facts.
Are you sure about this? Have you seen the actual judgment? I ask because:

1) Reuters says "A German judge said on Thursday an injunction sought by Apple banning the sale of Samsung's new Galaxy Tab tablet computers in Germany appeared valid because there were overarching similarities to Apple's iPad."

http://www.reuters.com/article/2011/08/25/us-samsung-court-idUSTRE77O0OU20110825

2) Apple's original complaint letter to the German court has a lot more details that just the Community Design registration and includes several photos for comparison of the similarity between the two.

The iPod was not the first and only music player on the market. It just got popular.

And why do you think that happened? ;)

‘You’ll Rule the World’
Alan Kay, regarding his reaction to the iPhone in January 2007:

When the Mac first came out, Newsweek asked me what I [thought] of it. I said: Well, it’s the first personal computer worth criticizing. So at the end of the presentation, Steve came up to me and said: Is the iPhone worth criticizing? And I said: Make the screen five inches by eight inches, and you’ll rule the world.

How does Apple want the Galaxy to look like? A pyramid?

Sony: http://www.sony.co.uk/hub/sony-tablet
Toshiba: http://thetoshibatablet.com/

Two companies who hired a designer instead of copying Apple.

Consumers are not losing at all if Samsung is forced to innovate instead of copying. I own a very nicely designed Samsung TV and a very nicely designed Samsung laser printer; I am sure Samsung could create a very nicely designed tablet. They chose the lazy and dishonest way instead.

It makes no difference to me who wins the case. It won't change my life at all. I was merely voicing my opinion just like everyone else here.
