Some of the 'moral high-ground' takers in this thread are ridiculous. There is no conceivable way that you can categorize it as theft to keep the laptop in this circumstance. That is one of the most blatant oversimplifications I have ever heard.

I'd keep it, if I could confirm that it was not intended for someone else who had paid.

People give way too much respect to multi-billion dollar companies that ultimately could care less about consumers. Apple had its highest profit ever in the middle of a recession, and they charge a significant premium for their products. The idea that consumers or the beneficiaries of their mistakes owe anything to them is absurd. Perhaps there would be an argument if corporations on a whole functioned at all for the benefit of their employees and didn't instead line executives' pockets with bonuses. The fact is that companies like Apple lead to further socio-economic stratification, and when a lower or middle class person receives a slight trickle-down of wealth, even through error, this is actually positive.

Some of the comments here speak to ignorance of the big picture.
 
Keep It, Keep It, Keep It

Keeping that MacBook is no different to eating a doughnut you have no intention of paying for while doing your weekly shopping in a supermarket. (We have all done it;))

If we really want to break it down, then keeping that MacBook is 'technically' theft, but then so is many other things we all do all the time; not paying for parking and getting away with it, finding a fiver on the floor and keeping it instead of handing it into a police station, the list goes on.

Whilst not wanting to trivialise a £2000 'technical' theft, the mistake is Apple's and Apple's alone. Apple don't deal with you accidentally dropping your MacBook and you don't have to deal with Apple accidentally sending you two MacBooks.

Keep stum and keep it.

Then you will be enjoying a stay in local lockup for keeping $20-100k in merchandise if they ever accidentally deliver the stuff for a high-end kitchen to your house by mistake -- especially when the address and name don't match.

The sheepish look on the family in the Phoenix valley family who tried this approach of they delivered it to me, it is mine approach, was priceless as the news report had them loading the stuff back on the truck and delivering it elsewhere in the subdivision.

Simply allowing Apple to correct the mistake in a timely manner without expense to you, and likely them letting you keep it, far outweighs the downside for trying to hide it.
 
I'd keep it. I have a feeling those who tell him that it's theft, are either, jealous or just very good people.

Have you ever opened your mailbox and found merchandise that you didn't order?

Next time, consider it an unexpected birthday present -- even if it's nowhere near your birthday!

Federal law makes it illegal for companies to send you something you didn't order and then bill you for it.

Winnie H. answered her door and found a deliveryman there with a big box for her -- a box she hadn't ordered.

Inside were books and a bill for $80. Winnie mostly reads magazines, so there was no way she ordered four big, leather-bound volumes.

She was wise enough not to pay for the books, but she did spend her time and her energy lugging the heavy box down three flights of stairs and to the post office.

And, of course, she paid for postage to send the books back. She didn't have to do all that. She could have kept the books, given them to a friend, or donated them (and taken a tax deduction!)

You have no legal obligation to let the seller know that you plan to keep the merchandise as a free gift, but you probably should.

I know, I know -- even having to write a letter is an imposition.

The thing is, alerting the company that you know the law should put a stop to any collection notices headed your way.

You may even want to send your letter certified mail to create a paper trail. Sigh.

Do Your Homework:
1. If you order goods that are supposed to be "free" or "trial" offers, scrutinize the fine print to make sure you're not signing up for future shipments that you'll have to pay for.

2. If you learn that unordered merchandise was shipped to you through an honest error, write a letter giving the seller a reasonable amount of time to send a courier to pick up the items. Alert the seller that if this doesn't happen in the designated time frame, you reserve the right to keep the merchandise or get rid of it.

Where to Complain:
If a company sends you unordered merchandise and won't back off about billing you, contact your local postal inspector's office for help.


This may be along the lines of your situation, but it's your call. Do the legal thing, or do the right thing.

Keep quiet, don't ring them ever again unless they ring you.

If they do, just say you're legally able to not give it back to them and keep it yourself, as you only asked for one laptop. Read the article above and stick by it. What is there to lose?
 
A MBP doesn't cost apple only $300. According to you a MBP cost apple a little less than 2 times as much as it costs them to make an iPhone. (The iPhone 3g only costs apple $175) While I haven't seen a iSupply breakdown of a MBP yet, I bet that it costs about $1000 to make a baseline $2000 MBP.

there is now way that it is $1000. may not be as low as $300 but its closer to that then it is $1000. i would say $600 at the most.

Now that they know you have it, it's up to them to contact you and get it back.
I wouldn't spend anymore time on it myself, open it and enjoy :)

I'd just leave it be and wait for them to call you. You've notified them, they made the mistake so let them do the leg work. Don't worry bout it and enjoy the new MBP (the one that's yours lol). You waited long enough to get it :)
 
...did you keep records of the conversation and who you spoke to?

If you have record of reporting it, leave it be, you reported it.

I wouldn't use it though until you know your getting to keep it legally with some sort of confirmation from apple otherwise you'll have to worry about wiping the disk clean.

Personally I would have probably opened the new toy when it arrived only to realize I didn't order the second one...then I'd have driven to an apple store to see what to do with the UMBP in hand...
 
Of Course you can keep it. If they send u an item by mistake, you are not obliged to do anything. One time, my neighbors accidentally received my Panasonic TV. I didn't ask for it back, I just called Panasonic and they sent me a new one. Enjoy your new 17 inch MBP :p

dont know how you got away with that one didnt they sign for it? Panasonic was pretty stupid to have let that happen.

Because some people are just that greedy. Unless they want to keep it to give it to some uni student without a laptop/charity case, they just want to keep it for greed.

As long as you called you are fine. You shouldn't have opened it though, it's not like it looks any different from the one you have.
 
Donate it to a school or homeless shelter for kids or something. I am pretty sure that will make about 10x more little kids happy which would boost the happiness and feel good feeling by like 10x for you too :) since everyone smiles at those cute little kids who always smile when they get something that they never even dreamed of.

I think apple wouldn't do anything if you said you donated it, I mean if they were as good as they say they are, then they would have done the same in a situation like this (if they were you). Don't keep it since judging by what you wrote (this was an extra macbook pro) that you already have one, you don't need another.
