Apple is typically 10 days if I remember right. But it would probably be much easier to just have them repair it. And there won't be any better features other than a slight processor bump - that is, if they release one at all.

The return policy is 14 days, so my advice to you is simply eiter call apple and ask them if it is possible to get a new one ( wait to do this after the MBP update with the new processors, if they are coming today) if you get a no, then use the return policy, and return the laptop, and youll get your money back. After that simply order a new one ;)

Or, you know, since he already has used the computer, he should just have it repaired so he doesn't need to go through a whole moving process again.

Sure, but if he wants a new one? And maybe the new processors won't have the whine anymore, or the heat problems... I would anyway use the return policy and get a new one. Its a win-win situation!
 
Figures - finally got delivery of my refurb unit last week. Depending on the changes I may be tempted to return it somehow.
