Similar thing happened to my friend with his iPhone 5. First one was lost in the mail. He called apple, they sent him another phone. A few days later the first one showed up. A week later he got a call from apple asking him to return the first phone. They traced the delivery and he had signed for it. He sent it back.

I know what I would do...mwahahahaha!

I'm sorry but if it's the insurance company that misses out I just don't care. Insurance companies are some of the least ethical companies out there, a taste of their own medicine is deserved

if somebody had sex with a prostitute against her will, is it consider rape or shoplifting
it's not stupid - stealing is stealing; it's stealing in another form. Get you're morals straight!

I think you would see a prostitute getting raped by someone and just walk by and say, she deserved it because she's a whore. The difference here is that he KNOWS his iPad has arrived after he got a refund. Sure it was a mistake but you don't go and collect just because you need to "let them pay". This world needs more people with moral values and ethical principals.

Blah Blah Blah

First mistake...asking for advice here.
Second mistake..reasoning it out in front of these same people.

My advice, tell everyone you returned it, then just keep it.

Do you think the shipper will tell their insurance to cancel the process if you tell them you got it?

The best thing about this thread is the fact that someone came to MacRumors forum to solve an ethical dilemma....

No, that's the saddest thing. That someone actually thought about doing something so ethically wrong. And add to that the fact that there are actually other people who think keeping it is ok too.

Sad state of affairs for the human race. There is absolutely no justification for doing the wrong thing - ever.

You bring up a good point. I am sure that UPS has an entire department that works to investigate these claims. I wouldn't imagine that they just shrug and take a loss of a few hundred dollars.
Actually they farm it out to a totally independent "claims adjustment" company. I have their name at the office. The seem to get a commission on every claim they REFUSE because they seem to refuse quite a few that are obviously UPS fault (items damaged inside a box).

Don't return it. Apple or whoever you got it from is getting reimbursed through their insurance claim.

I know what the moral says... but I dont like UPS!!!
Apple gets money either way.

Sale it now. Christmas came early for u lol

UPS get their money also. They know it was claimed but had to deliver it anyway. Since an insurance claim was made they have to deliver it. Someone is double dipping in this process. It might as well be you.

You can pretend that you didn't know which is which. If you're lucky, they won't track you and after 30 days have past it would be safe to open the second and start using it.

guys... i know what yall saying, and i agree.
but if you were in my position, right now... some of you would at least thinking about keeping it...

Your not robbing anyone. You paid for insurance. You people are complicating something that is not.

He paid for insurance, apple and UPS are getting paid for it. Now your telling him to pay one them twice. Come on thats the stupidest thing that I have ever heard. Do you think the insurance company is losing money

Its how the system works. He ordered something and paid for insurance. It was lost, so a claim was made. After the claim was made the shipping company delivered it. Apple got paid and so did UPS. He was inconvenienced and is the customer. Its his merchandise because apple was PAID. Do you understand that? He didn't steal anything. You make no sense.

Obviously the question is not what you should do. We all know what SHOULD be done.

And I can honestly say if it happened to me, I would do nothing.

I know what I would do...mwahahahaha!

I'll assume all of you have home owners or renters insurance. With that being said, what are your addresses and what times are you guys usually not home? My wife is pregnant with our first child and I'd like for us to have one hell of a good Christmas! Everyone gets paid and we all win. There is no downside! :D

Here's the thing man. At the end of the day, right is right and wrong is wrong. If you return it, you can rest assured you did a good thing. If you keep it, though, you'll always have a wee bit of guilt tucked away back there somewhere.

For all you know, you'll call, they say just keep it, and you win, both ways.

If you take it back to UPS somewhere will just keep it.

This is a valid point. It's quite possible somebody will keep it as it's going to be lost in the system. The only way around that is to call Apple directly and set up a return.

BUT... You could always keep it sealed for a while as another poster said and see what happens.

Personally I'd return it, but I also wouldn't blame you if you kept it. Actually, I'd be happy for the OP if he got to keep it. It's a bit of luck that most of us don't encounter apart from those rare occasions.

As to the person who called bad karma, perhaps this is karma repaying the OP for something he/she did previously...

This thread is pointless, seems to me the OP had already made their mind up before they put it on here and was just looking for others to tell them it's okay to steal.

This thread is just not right. Hopefully you started this thread to just play a little with us Macrumor members. If you are really serious about asking what to do - you already know what you are going to do and we can't help you. You know the saying, "what goes around, comes around"....

what position is that - of someone who shouldn't have been spending over $500 on a toy in the first place?

grow up and do the right thing - which is stop trolling because I don't believe this really happened.

Don't return it. Apple or whoever you got it from is getting reimbursed through their insurance claim. Its part of the shipping process and consider yourself lucky. Insurance is getting paid, the postal service got paid, and so did the vendor. I know it sounds bad but thats just how the process worked. You didn't ask for this, steal it, or do anything wrong.

Insurance companies can claim goods that they have paid out claims for.
