I dont see why its apples responsibility to get you a new phone immediately. Your phone was stolen by a fed ex employee. It sucks it happened, and im sorry it did, but it does happen. Im sure fed ex has insurance that will replace your phone, and apple is more than willing to send you a new phone and work it out with them, but there just isnt enough phones to go around right now.

I know your angry and upset, but holding apple responsible isnt going to get you a new phone any faster. If fact you should be thankful that apple isnt making you wait while an investigation and insurance claim are followed though at fed ex.

They don't have to...but this is the type of thing that Apple generally does, which is why folks tend to gush about their customer service.

I know this was addressed to the thread starter, but I thought I'd respond.

I don't feel that it's Apple's responsibility either, to give anyone that has had this happened to another FREE phone either... But they are the ONLY ones that can actually do anything about in a timely manner.

The big kicker with this too, is that FedEx will only reimburse the original sender. So, with that being said, it does fall back on Apple to make it right to their customers now and get themselves taken care of on the back end.

There's way more to it than that as well... The Apple customer service rep that I talked to offered to refund my money, but that puts me in a really strange situation... Because I only paid $299 for the 32G iPhone 4 since I was due an "upgrade" through AT&t.

If they refund my money, then what do I do... AT&T see's it as I already used my "upgrade" so then I'm left having to pay another $699 to buy another phone.

It's a crappy situation all around. Thieves suck... I can only wish really bad things happen to the one that stole my phone!!!

I agree with str8boostn---

Do I think it is Apple's fault that FedEx had either "faulty" equipment or thieves? No, of course not.

However, in my viewpoint-- Apple's contract with Fedex-- didn't really give me a choice to add additional insurance, to overnight it, etc. All of us are at their decided upon process for the launch.

FedEx also advised me that I would have to deal with Apple since I signed for the package -- this came from some security person at my local facility, the customer advocate from somewhere out west, and the guy who answered at 800-GOFEDEX.

FedEx is not going to compensate me-- I am the buyer not the shipper.

They told me I would have to work with Apple to rectify closing the phone account, etc.

Now, from my standpoint (and I am sure that str8boostn feels the same), I opened this package RIGHT IN FRONT of a FedEx representative-- who immediately called her management. It is pretty obvious that I played NO part in attempting to fraud anyone. As a customer who spent 399.00 for a phone that took hours to order (it was 10 or so), I do think as customer goodwill that yes I should receive an iPhone within a reasonable period of time-- not being placed at the back end of the queue.

FedEx will pay Apple and have to figure out what is happening. This is not some ebay seller or even some small package from any ordinary company-- this is a package sent that I am sure had a significant project plan to execute over 600,000 deliveries. I don't think it is unreasonable for me to think that for something I had absolutely no control over and whether there there was obvious foul play or crappy machinery, to make me wait as if I had never ordered one as a pre-order with a delivery by date.

I am not asking Steve to give me 2 iPhones or even upgrade me from a 16g to a 32g or heck even give me a bumper-- I am just asking to get what I paid for delivered as close to the time that I was due to have it delivered to me.

Are you serious??? I am also in NC---

Mine went through Raleigh.

I'm new to this forum... But I didn't see any way to private message you... I just called FedEx back and gave them some more info... They seem to be kind of useless... I have a screen shot of my FedEx tracking time line if you want to see it, just send me a message... Who knows, maybe this could be good and we can find the a$$ that did it.

you and str8boostn both need to keep us all updated on how things are handled! let us know if they catch someone and what happens!!!

Exactly... I just want what I paid for as well... When I opened that box and it was empty, I almost threw up... Because I knew it was going to be a major pain to get this resolved...

On a side note, it's hard for me to believe that Apple didn't have the foresight to see similar situations like this happening with over a half million being sold upon release. You'd think they'd have at least a few extra to help resolves problems that may arise.

It does that when it goes thru the hub. The "scanner" gets the official weight and dimensions of every package that goes through the sort!

ya i figured that was the cause. i was just responding to someone else who was questioning about someone else who's weight changed to let him know that the weight goes up 1 pound, not down, as it would if it were stolen.

Here it is... I can't stop shaking my head in disbelief... I knew I should have just scheduled it for pick up at a local store... But there isn't an actual Apple store near me.

You guys must not think fedex and ups drivers are having a field day with this. I wouldn't be surprised if they weren't all trying to get a couple of these things..

thats the way you think? describing your tendecies if you worked there? my bro works at UPS so I take offense to this. Some guy that was working during the holidays was trying to see if he could get some freebies. He asked my brother about maybe "misplacing" a baby stroller as his girfriend was pregnant. My brother flat out told him.. seriously? you think I am going to lose my job for you? because of a stroller? .. he told him, I tell you what, I rather buy you one. He finished by saying. you have two options 1. I dont buy you one, you get to keep your job, but you will no longer be helping me. 2. I buy you one as your farewell gift from UPS.

Integrity. obviously you must think down the line of these guys

I hate stupid bummy ass thieves. I hope you guys get a new phone soon and I will be sure to shake the **** out of my box before the FedEx guy takes off.

i wonder if there is a way for apple to track these stolen phones? like each phone has a specific serial number, and they all have gps tracking on them. wouldn't apple be able to recognize when a phone with a specific serial number is activated?

Well for what it is worth, both FedEx and Apple (well Apple already had the serial number) asked for the SN.

I really think it is VERY highly coincidental though that we both had our phones "fall" out of their secure packages and had the same itinerary.

If I were FedEx, I would really be checking out the Raleigh Hub as well as however we were sorted in Memphis.

Sketchy

I asked the Apple customer support guy the same thing. iTunes recognizes the serial #'s to the iPhones... Why can't they just block that serial # from ever being able to be used... Seems simple enough to me. But in a round about way, he told me that it's just too much trouble and not worth the time/money they would have to spend fighting such battles.

Here's another kicker though... I asked if when they ship me the new phone if I would just be able to have it shipped to a local store so that I could go and pick it up there and he told me that it would have to be shipped to my home address. So great, this could happen all over again!!!

Well for one thing-- I can say that my driver acted very very concerned. As soon as I noticed something off, she went to shaking the package too-- and she was the one who really encouraged me to open it up.

I dont think the drivers are crooks-- I do think something shady happened somewhere and I hope the person/people who were shady find themselves unemployed for cause very soon.

I cant imagine whereever these phones are now-- that ANYONE will be trying to connect them here in the US... I am sure they will be on ebay to an international sale.

There is an extra phone some where. You act like there are no phones to be had!

Just for reference, iPhone 3g launch lasted from launch day through the weekend at my local store. They ran out of phones Sunday night. iPhone 3gs was much the same. This man just wants to be promised one. Nothing wrong with that when the supply is HUGE.

Yeah, I think Apple should require serial #'s be present for selling iPhones... Just like auto's...

I know that sounds crazy, but hey, if you're legit, it shouldn't be a big deal!

No serial # = NO SELL

it's alot easier for a handler working at a hub to "take" something then it is for a driver to "take" something. The courier with Fedex has about five different scans on it that ties the package to the courier!

Look at it this way, the joke is on whomever stole it. It probably has screen and reception problems.

so it's either on Memphis or Raleigh?

Most likely, but they also went to Anchorage, AK and Newark, NJ... But I would have thought that anyone of those places would have noticed the way mine was opened and extremely light... I'd say that the best bet would be Raleigh... I just don't see how it would have slipped through all of the other ones opened and no one noticed...

I actually showed the pics to a friend of mine who used to work for FedEx Ground as a handler. She said that when packages got gnarled up in machinery it was OBVIOUS. Like-- not a pretty package that for the most part looked a little worn and then had some item still shoved back into it.

I think what really convinced me that this was not a "machinery" issue is that others have said that the iPhone has some plastic wrapping to keep it stable in the box-- that makes me think that it is pretty amazing that the iPhone box managed to get away from the cardboard backing AND the shrinkwrap-- when the cardboard backing managed to get back into the shipping box.

RIIIIGGGGHHHTTTTT and pigs fly.
