Yeah, it's wiki-crap - as the jaguar logo wasn't used, this wasn't a brand of car and is in a different sector entirely, no copyright or trademark would hold true - you can't restrict the use of an animals name if there's no infringement of intellectual property or trademark.

Yes, they do a lot of the drossy reality shows, but they also do make quality programming (or commission it, depending on the show in question). You may not like some of their drama shows, but that doesn't mean they aren't well made.

And yes, ITV would have spoken to their lawyers even though this is only a rumour, and they have probably spoken to them since the Apple TV was launched, just bearing in mind the possibility that the device may be re-named at some point to match the other 'i' devices.

The story in the Daily Mirror is, no doubt, completely over-played and nothing like what is really happening within ITV itself.

I dont think any of those shows are being made any more. Why bother spending money on quality drama when millions will tune in to some has-been or never-was eating kangaroo balls in the Australian jungle.
 
Apple using iTV would probably bring more brand recognition and help that ****** TV channel more than anything they could ever come up with. They should be happy people might assume Apple's iTV and their iTV are the same thing or are related.

"Pop Idol" - Sold to US and now the biggest show there (American Idol)
"X-Factor" - Soon to be in the US
"Britain’s Got Talent" - Sold to US and now the second biggest show there (American Idol)

Maybe being associated with a company like apple will make them well known, nobody has heard of them at the moment!
 
As trades CAN be international under certain fields, this would directly affect this as an infringement (unless agreements were made).

Its not about growing up, im well educated in this area Ive personally dealt with all this before, for the UK company to come out with something as petty as this it could potentially open the doors for Canada's iTV to break agreements and get sole name (International Trade Name).

UK company could be biting into a big area that goes internationally and end up losing their shirts.

Think for a sec, if you owned iTV before another company (internationally) and the younger company opens its brewhaa of lawyers for this wouldn't you want to make sure YOUR trade name is not jeopardized?

UK thinks they own everything and everyone, iTV Canada will sit back and watch then strike just as UK gets deep into this and the costs will mount so high the UK company will have to negotiate.

Actually, you're wrong. You can only trademark if you're unique, first there and no one else has existing branding who could object to the application. To attempt a post-date international trademark with several other established organisations already out there with established branding would fail. It's not "oldest wins", although I'd imagine with a forming date of 1955, the UK's ITV would probably be the oldest. There are Several BBCs in the UK, including the Boston Bean Company. As the industry sector is different, there is no conflict. iTV would be in conflict with ITV as ITV already have their own online media streaming service.

I have some serious doubts about the source of this information, but hey it's a great bit of free publicity for a somewhat forgotten device, well compared to the iPod, iPhone & iPad. iTV in for the UK would be a bad name, when I see those letters I think of a TV channel, not a box made by Apple, that isn't going to change no matter how good it is.

There's nothing wrong with TV it works. I don't think adding an i will make it anymore popular, a bit of Apple magic will. If the 'i" is so important why not something like iVision, iBox, iTelly, iPort, iLounge.

Bringing it back on track, can some please remember:

1) The story of the name switch to iTV was a rumour
2) The Mirror story is a rumour
3) Those questioning UK law don't have a clue. It is one of the most litigious countries in the world with an effect that crosses borders. Super-injunctions are run here, not the US! When US companies/celebs take cases to court, they deliberately use the UK and not the US. Same with trade disputes. I'll mention Trafigura or Andrew Marr before this site is swatted upon.
4) ITV (TV Company) has a right to defend its copyright. Whatever those here might think of its reputation or output, it has the right to uphold it. And as far as I can see, Apple will lose.
5) ITV, although having a UK base, has worldwide interests and has therefore a UK/US (and more) trademark.
6) This has not been mentioned in the thread, but people are fogetting ITV has been involved in an set top digital content box. This was under the umbrella of ITV Digital, and although it has now folded, they likely hold strong trademarks and conditions on the ITV name attached to digital TV and content provision.
7) Although not the greatest name, people know what the Apple TV is, and to change it again just adds to Apple's mess of this project. The whole "i" naming is very 1990s anyway.
8) Oh, and Apple can't just buy ITV off the shelf. Unlike Channel 5, there are laws preventing this. ITV is also a group, so Apple would need to buy them all.

True, they have produced some really popular programmes. Nothing I'd watch but I am impressed by their popularity.

They also produce Coronation Street and Emmerdale which are supposed to be very good (doesn't Corrie hold some record for being the longest running soap in the world?).

Putting a ******* "i" infront of everything they make is getting very lame. Fact is ITV is a established brand in the UK, irrelevant of what poeple think of the quality products they broadcast, at this rate when is Apple going to rebrand itself to iApple?
 
Yeh but iTV isn't just a product thats going to be sold in the US.

Nor is ITV just involved with the UK, they ship out programmes and concepts all over the world. Some of the shows made by ITV have become some of the most popular shows in the US (nelmat's post).
 
Likelihood of Confusion

Don't quite see why ITV are so angry... I really doubt it would be difficult to obtain an injunction against Apple launching an iTV product.

UK trademark law requires there to be a 'likelihood of confusion' amongst those using the product/service. Clearly a device that shows video content and a (crap) TV channel are too similar... "Yeah, -insert TV show- is on i/ITV". If it were ITV Helicopters Ltd there would be no problem.

So ITV, why don't you simply send a nice letter to Apple reminding them you exist, or go to court and be done by lunch? Plus remember it is only a rumour!
 
Quick publicity

ITV is just looking for some cheap publicity for a company that nobody outside the UK has heard of before. The "iTV" name is only a rumor at this point anyway.
 
If the iTV is real, Apple won't need to buy ITV, they'll probably offer a tidy sum to ITV for the use of the name in consumer electronics, and ITV will bite their hand off.

Why say no to a few million pounds of unexpected revenue?

They went through the same thing with someone else already using the name iPad. Both sides were using it for different things so they talked and compromised. If they want it they'll likely do the same thing.

ITV is a pitiful TV station which makes lowest common denominator 'entertainment' programmes and laughable soaps. I hope that they lose this battle. I really do.
