I wonder how many times you're going to need to be told that it's not how many fingers used, but HOW they are used that Apple is suing HTC over?

You shouldn't be able to patent how I use my fingers. Though, on the positive side, I could finally charge your mother licensing fees...

Ehm, Apple lost marketshare from Q4/09 to Q1/10 (also already from Q3/09 to Q4/09). Nokia had their best ever smartphone sales in Q1/2010. Also Nokia sold almost more smartphones than RIM, Apple and HTC together. Nokia's revenue (almost only phones) was higher than Apple's (phones + computers + ipods + itms + hobby apple tv). With the Nokia 5800XM Nokia has the best selling touchscreen smartphone in history.

And with new stuff like the N8 they don't have to worry anything, especially because some tech sites in Europe reported today that Nokia will already release the N8 in June and not in H2/2010 like most people guessed before.

Where did Apple lose marketshare? Not world-wide, as they've increased dramatically year-over-year.
 
I wish they'd just settle this, being dragging out.

I think it's a strategy that many corporations play - infringe for right or wrong, dominate the industry, then write a check for a few billion $ in compensation years later ... giants like MS have done this in the past; Apple still has a long way to go in the smartphone industry and this thing can really drag out.
 
This is just another greedy manufacturer with crappy products and wants to make money some how.

If you look at NOKIA Stock between five years and now. You notice that stock climb till January 2008 when Apple announcement new iPHone 3G WITH Apps. Stock went rapid down and never go back higher for two years.

Nokia seek the money. Stop theft, you are son of b****.

Too much Apple? You lot seriously need to grow up. Nokia are suing for a legitimate reason: they feel Apple haven't compensated them for their patents.

You say that but Apple's cash reserves are in the region of $38 billion and Nokia's Market cap is 42. They'd have to offer a better price, but Apple aren't far short and could get there within the year.

That's just an interesting fact. Of course they are better off using that cash to take on multiple companies on multiple fronts in the Market place. But it is interesting. Also interesting that they could buy dell outright right now. Anyone remember michael dell's comments back in 97?

Companies that don't make products to sell = NO PATENTS, ever, period, done. I'm sick and tired of "well, we thought of it first, but never really did anything with it but were going to sue your ass because we own it", BS.

If they're suing because of lost profits, how about using their own products on a daily basis and find out.

Maybe its ridiculous to you, an observer ( who on all probabilities know very little about cell phone communication technology - may you do - in which case you could take the opportunity to enlighten us? ) . Nokia obviously thinks differently.

Like all patents, we've all seem some stupid patents, even from Apple. However, our personal thoughts on patents count for very little.

One of my grad electrical engineering classes was in microwave engineering, and dealt mostly with antenna design. I can assure you there are not only an infinite number of such configurations, but figuring out the right one for a given product takes an awful amount of hard work and, sometimes, innovation. (Patents are only awarded for the latter, of course).

yes. But it will be quite awhile before anything interesting happens in court.

when journalist, analyst etc say apple (or any company) has $40B+ they really mean Cash+short term+long term investments. Basically they mean how liquid or near liquid assets they have and can deploy.

Mind you, a company can always borrow/leverage against their own stocks... in fact, that's how it's often done.

Nokia has some of the best internal antennae designs on the market.
Take any 3G Nokia phone and put it up against the iPhone and see which one holds a signal better.
There have been more than one occasion where my N75 work phone has been able to place calls and pull up web pages where my iPhone displayed No Service.
Both are on AT&T.
 
Even Apple admits in their document that Nokia offered license terms that did not involve any cross licensing. In fact, Nokia offered such terms twice. They also offered cross licensing deals as such deals are very common way of handling licensing. That does not make Nokia demanding cross licensing.

I thought that it came out that Nokia licensing costs were based on a percentage of the sale price of the phone. Apple's argument is that an iPhone is more than just a phone and that the licensing fees should only be paid on the part of the sale price that is attributed to the phone part.

This argument may have just been speculation, of course.

...though, I gotta say, less culture than what? From the distinct native cultures all the way up, to the most colorful amalgam of foreign cultures in the midwest in Madison in the south, Wisconsin is one of the more culturally interesting states I've ever been in.

...or did you mean less culture [shock] and less climate shock...
 
I think I know the next big thing in manufacturing wealth. Forget credit default swaps and collateralized debt obligations -you don't need to create exotic securities derivitives to manufacture wealth out of thin air. All you need to do is file a patent application for technology you have neither the capacity nor the ability to actualize, and then sue anybody who eventually does.

What you're describing happens, but has nothing to do with this case. Nokia sells cell phones that use many if not all of the patents in question. So they clearly have the capacity and ability actualize the things they have invented and patented.

Apple's contention (whether true or not) was that they were perfectly happy to pay the licensing terms, but Nokia wanted a patent cross-licensing agreement instead. Apple said no, since Nokia's patents were transferred to the GSM consortium they have to grant the license as a fee only to anyone and can not single out Apple and force them to do a cross-license deal instead. If Apple wanted to do a cross-license deal instead, that would be fine, but Apple doesn't want that. Apple has been arguing that since Nokia is not letting them license the patents in the way required for patents in the GSM pool, they will wait until a court tells Nokia that they cannot try to force different terms on Apple.

You're whole tone paints Nokia in a bad light, but given how arrogant Apple acts in general I'm guessing they were the ones who pushed for better terms than what other cell phone makers get. From what I have read cross licensing is very common between the cell phone makers when dealing with patents. The 'fair' cost often ends up being a mix of cross licensing and cash. Nokia only has to sell the GSM licensing at a fair cost similar to what they charged others. Given how most of the industry works they likely charged others a mix of cash and cross licensing. Apple clearly doesn't want cross licensing and also probably didn't want to pay an increased cash cost to cover it.

At this point both Apple and Nokia have agreed through their actions to let the court decide how much Apple will pay for the licensing. They will pay, it's just a question of how much.

Absolutely. I only used Nokia phones until I bought my first iPhone. Then I got a taste of how bad the phone part worked on the iPhone 2G compared to any of my Nokia phones. The 3GS is better, but still drops calls way more often than it should.

No, Apple lost world wide marketshare in 2009. They only sold more phones but didn't keep up pace with the general smartphone and phone market.

And in Q1/2010 they only have 16.1 percent. So they are down 2 percent from Q3/09 to Q1/10.

And for 2009:

"Android’s marketshare grew 44 percent during the past quarter and almost 100 percent the past year. This is while the iPhone’s marketshare fell 4.5 percent and 10.2 percent during the same periods."

you're looking at a different balance sheet to me. I see 7 biilion cash and 33 current assets. I underestimated. Take off 12 bill current liabilities if you like, but why?

Apple had the highest growth of any of the major smartphone manufacturers over the last year.

Excuse me, but Nokia has used these patents extensively in their phones since the patents were granted. How can you say they are just sitting on them?

Do you guys even understand how much Nokia invested in R&D when the industry was new? Apple came VERY late into the game when phones were relatively modern and just added some bells and whistles on top of the extremely costly technology that they ripped. A phone is SO much more than a nice UI and a touch screen.

Apple is their normal arrogant "I don't like them, hence I'll bitch" here, but this time they are barking at the wrong tree and finally getting what they deserve. (Unless the US court favors American companies, which it is known to do).
