If their only mistake was not notifying people, then why would they add the option to turn off this "feature"?

it’s about not giving stupid people something to complain about. let them be offended at Apple trying to extend the life of their device. let them turn it off and get pissy about the performance getting even worse. i’d rather have a slower phone with an extended lifespan than a fast one that is going to burn out.

They can't degrade performance without notice. It would be like BMW taking the turbo out of your car in the middle of the night and not disclosing it.
Do you own a BMW? Let me tell you what BMW did. I own a turbo BMW.

Used a faulty HPFP that caused “limp mode” for affected cars (basically every 135, 335, and 535 ever produced).

Introduced a SOFTWARE update that essentially slowed down your car and retard timing to mitigate issue.

Used faulty injectors that used 20% more fuel than spec when they started to go bad.

Denied everything and still do. Basically, they just extended warranties and fixed the issues as they come. No compensation. There were tons of class actions, no real action. I was part of one.

So yes, BMW did much worse.

And Apple can do whatever they want to your phone with their software.
 
I can see it now. A Senate committee formed..everyone gets lab coats and lithium ion batteries and spend years testing what causes batteries to lose voltage over time and charge cycles.

Or...just read all of the literature out there about battery lifespans and decide if Apple should let iPhones die earlier or slow down to extend the battery life.
you should get more info on how that stupid feature significantly affected performance of perfecly working phones not affected by ANY restarts or obvious issues

I don’t consider clock speed reported by an App or benchmark a reliable source of device speed.

For that you’re going to have to run some Apps and compare their speed and responsiveness.
So you want us to run Apps to consider the clock speed, but cannot rely on a benchmark app for the clock speed?

Nothing the government needs to be involved with. If the company wasn’t named Apple there wouldn’t be a government investigation.

Multiple Governments are investigating this issue with Apple. Throttling users without any notice is not acceptable. Apple should be replacing everyone's battery for free that was impacted by the throttling. Not like that will ever happen though. Where is iOS 11.3 with the throttle button already? Apple is sure taking their sweet time in releasing that update.

A quick scan of the iOS TOS for iOS 10 makes no such claim regarding hardware performance.

It's not a "hardware" performance so much as a software/firmware performance issue. Under the iOS terms you kindly linked to:

"7.2 YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT, TO THE EXTENT PERMITTED BY APPLICABLE LAW, USE OF THE iOS SOFTWARE AND ANY SERVICES PERFORMED BY OR ACCESSED THROUGH THE iOS SOFTWARE IS AT YOUR SOLE RISK AND THAT THE ENTIRE RISK AS TO SATISFACTORY QUALITY, PERFORMANCE, ACCURACY AND EFFORT IS WITH YOU."

That covers exactly what is going on. If you accepted those terms when you started using an iPhone (which you have to do to use an iPhone) then you really don't have much argument to make.

I'm not saying what Apple did is the correct thing, I'm just pointing out that it's covered under their disclaimers in the Terms & Conditions agreement.

Can't play that card either. We'll try to redirect it into casting Amazon as the villain there... even if the latter was basically getting books to us consumers at a lower price, while Apple was trying to get more out of us. We just can't bring ourselves to fault Apple in anything. It's got to be someone else's fault.

If it came down to Apple vs. Mother Theresa vs. God vs. our own Mothers, those other three would be wrong too. ;)
 
To play devils advocate; iOS terms of use say they can.

Terms of Use don't override the Law of the Land. They have to be within the law.

An (exaggerated) example that would be unacceptable in the eyes of the law and would be thrown out: "You accept your first born will belong to Apple by opening and use of this product ".

What if the device is out of warranty? Is Apple required to replace the battery for free?

Because some people just get all bent out of shape over a minor inconvenience...if they even noticed it...and want to have their moment of outrage. Apple is allowing them to make it all better. That's why.
