My point is, they aren’t doing that, BMW was sued, nothing happened, and Apple actually fixed the issue once they realized people were pissed and it affected some people too much.

Do you own a BMW? Let me tell you what BMW did. I own a turbo BMW.

Used a faulty HPFP that caused “limp mode” for affected cars (basically every 135, 335, and 535 ever produced).

Introduced a SOFTWARE update that essentially slowed down your car and retard timing to mitigate issue.

Used faulty injectors that used 20% more fuel than spec when they started to go bad.

Denied everything and still do. Basically, they just extended warranties and fixed the issues as they come. No compensation. There were tons of class actions, no real action. I was part of one.

So yes, BMW did much worse.

And Apple can do whatever they want to your phone with their software.

If can apple can do wahtever they want why did they reverse the throttle huh???

Fine for what? Extending the life of older phones? Because that is what power management does.
 
One of the largest companies in the US misleading customers, spurring dozens of class action lawsuits. I think it's totally reasonable for the government to look into it.
And also reasonable to believe nothing will happen because there are mitigating circumstances discussed ad nauseum.
 
Sadly, this was an entirely unforced error on the part of Apple. No matter what your view of their ultimate explanation for the throttling, their handling of the matter was an own-goal. Personally, I think their explanation made sense. But they bumbled around, staying silent while people complained, staying silent while people speculated, and only going public after some people used very clever sleuthing to figure it all out — and then they spoke up. At that point, human nature being what it isn, no one with a suspicious inclination is going to buy your explanation. Oh well.

They didn’t reverse it as much as they playcated customers by allowing them an option to turn it off. It isn’t going away.

And yes, they can do whatever they want but they also listen to customers. Good on them. Just because they are right and justified doesn’t mean they won’t listen when the consumer complains. They never admitted they were wrong...I don’t believe they were either.

It sounds like Apple is doing similar thing that BMW did to its customers. Only difference is that Apple apologized whereas BMW didn't.

The correct course of action would be for the gov to thoroughly investigate BMW customer complaint.

You are suggesting if gov let BMW go easily, they should let Apple go easily too.

The only thing Apple is guilty of is not being very clear to customers. Power management is not about selling new phones. It’s about extending the life of phones with older batteries.

Basically they are guilty of not spoon feeding this fact to the public.

This was already proven by independent sources.
 
It's ridiculous that people are still defending this. Slowing down premium devices regardless of age is unacceptable. $700-$900 is a lot of money for a phone. It's an investment that should last for more than two years. Many people don't upgrade every year. Some people save up and treat themselves to an iPhone when they can afford it. Imagine spending all that money just to have your device throttled. Apples solution is to live with it or buy a new phone. Pathetic. They deserve all this negative press. And it's about time the slow down issue has been made official. Perhaps with all this talk of iOS 12 improving performance instead of bloating iOS more than it already is will be a step forward in positive direction!

All Apple did wrong was not notify people. That’s being corrected in a future update, you can toggle it if you want, and Apple is giving $29 battery replacements. It’s a non-issue that many people are hoping and praying turns into a major problem for Apple. They’re going to be so disappointed.

I sincerely doubt you could justify that straw argument with any other major product. When you push code stealthfully that changes the performance of devices you manufacture, that is equivalent to changing the code on a VW diesel to pass inspection.
The purchase was made with a specific specification for performance and that performance was changed. I think the EPA wouldn't buy that.

This took 9 years at BMW and there are still issues.

I’m suggesting Apple didn’t do anything even remotely as bad as BMW. I don’t even think Apple did anything wrong. They just misjudged the impact for some users and/or there are some faulty batteries.
 
This has gotten beyond absurd.

Apple can do whatever they want with managing CPU and battery performance on any device at any time. It is beyond insane to suggest that anyone outside of Apple has any right to any particular level of CPU performance at any given time.

Tim Cook has embarrassed Apple by admitting wrong where none existed and has opened the company to undue scrutiny.
Thankfully Apple can't, if they want to sell their products they have to obey the law, and respect the customer rights.
 
It's not a "hardware" performance so much as a software/firmware performance issue. Under the iOS terms you kindly linked to:

"7.2 YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT, TO THE EXTENT PERMITTED BY APPLICABLE LAW, USE OF THE iOS SOFTWARE AND ANY SERVICES PERFORMED BY OR ACCESSED THROUGH THE iOS SOFTWARE IS AT YOUR SOLE RISK AND THAT THE ENTIRE RISK AS TO SATISFACTORY QUALITY, PERFORMANCE, ACCURACY AND EFFORT IS WITH YOU."

That covers exactly what is going on. If you accepted those terms when you started using an iPhone (which you have to do to use an iPhone) then you really don't have much argument to make.

I'm not saying what Apple did is the correct thing, I'm just pointing out that it's covered under their disclaimers in the Terms & Conditions agreement.

Their terms and conditions are a joke and doesn't amount to diddly squat. If they want to play throttling games then they should let users downgrade their iOS anytime they want. Give the customers the power to control their experience which Apple will never allow to happen!

None that I'm aware of. Of course, you're missing the point. Whether that's deliberate is something I'm unable to determine. I would explain it to you, but you're ostensibly capable of going back through the posts yourself.
 
I dont believe Apple when they say the only reason they do this is to hold battery on par. My 1st gen apple watch has become SO slow with each update that now currently starting a workout can sometimes take a minute or two before it starts. Worst case it just seem to completely stop. And recently I sent my watch in for repair and Apple gave me a brand new one, so the battery should be completely fine. But the watch is slow, almost to the point it's not worth keeping it anymore.

Terrible comparison. Software changes, and usually for the better, and as it does, it gets more complex, and it has more overhead. It only makes sense that older devices are NOT going to run the latest software as quickly as the new hardware. A late 2009 Macbook designed for Leopard running High Sierra isn't going to run as fast. Software always outpaces hardware. You want it to run fast? Get the shiny new hardware. If you want the new features in the new software on old hardware, you better get used to waiting.
 
......just read all of the literature out there about battery lifespans and decide if Apple should let iPhones die earlier or slow down to extend the battery life.

My past experience with portable electronics have been battery life decreases as the battery ages and gets used. Never have I had a device suddenly shutdown when the cpu is at 100%.

When you look at the graphs from the Geekbench report [1], very few people got throttled. I suspect those people have batteries with manufacturing defects and Apple released this software fix (Apple Sudden Shutdown fix or A.S.S. fix) to avoid a wider recall [2] and free battery replacements.

To make matters worse, I was at Apple the other day getting my iPhone X screen fixed (they made me come back to the store 3 times and ended up just replacing it instead). Anyhow, this other guy was there to get a battery replaced for $29 on his 6+, they told him they could order the battery now but the repair likely won't be done til late March or April. Needless to say he was super pissed off. As a third party repair shop owner, Apple's piss poor customer service put a huge smile on my face. I have plenty of 6+ batteries in stock. :D

Just keep on sending all those pissed off customers straight into my loving arms, Apple.

why were you going to apple to have your phone repaired? You're a third party repair shop owner.
