Really? You think that's pathetic while Galaxy S2's get banned in Europe due to the gesture used to switch between photos..... My goodness, neither of those things should have been granted patents in the first place!

Are you comparing a gesture with an Airplane icon? Really? Gestures being patented makes as much sense as patenting a touchpad or a mouse. They are input methods. And quite successful ones if other companies copy the ones Apple patented instead of coming up with their own gestures.

Apple innovates, Samsung copies, that's the truth.

says who? In my opinion, this should be: Apple designs, Samsung constructs. Samsung is highly innovative when it comes to integrated chip-design and screens - Apple uses Samsung components in almost every device they sell.

Fact 1: Samsung holds key patents on some of the most basic components of every cell-phone. Apple is using those without paying royalties. So are others; but others weren't suing Samsung, that's why Samsung isn't going after those yet. Please note that none of the previous rulings against Samsung actually deny this. They simply state that because these are basic patents, there won't be any injunctions; instead, international laws demand that Samsung has to offer Apple usage-rights for these components for a fair price. And Apple indeed DOES have to license them. If they don't, they will eventually get punished for that.

Fact 2: Apple's patenting designs such as "rectangular shape with rounded edges" is a joke. They didn't invent that and will most definitely lose those patents at some time, as they are too generic and because shapes like that have been used for centuries. The judge who granted them those patents either was high on pot or was an Apple fanboi him/herself.

While I find the whole patent war to be highly childish and stupid, one should also not forget that it was Apple who started the whole kindergarten. Samsung was pushed into the defensive and that's where they're acting from now.

I doubt any judge anywhere on the planet will grant Samsung an injunction based on said patents. Simply because that would be against international trade laws. However, it's pretty clear that Apple has stolen patents here as well.

Samsung will one day get itself banned in return of filing too many lawsuites against Apple.

Smartphones are specialty of Apple and they are the pioneers, thats why samsung should stay out of the smart phone world.

I just want to have a lawsuit from Apple again samsung to ban all their smart phones, then only samsung will come to its sense...

copycat losers...

Despite some die hard "anti-Apple" people that no matter what happens in court will say that nobody copied anything (usually Android lovers by the way), I think this whole movement by Samsung is one of the worst public relations they could have done.

I for one always looked at their products and brand with a good eye, now, I just avoid their products basically because I completely dislike the way they have been handling this.

You know! I agree with also. I have been a fan of their TV products for sometime. I believe features wise they do have a good smart phone, but I am concerned about their quality (though I like their TV, but it does have quality issue). This is going to hurt Samsung a lot down the link. It is going to heard their branding!

This may be two huge companies fighting high cost legal battles, but doesn't anyone else think this is escalating to a childhood squabble?

Perfect. To add my bit, I wish all patents just went away, especially software and "look and feel" (ok, also biotech ones) as they are just plain retarded.

Also, fanboys, wtf. You are not what you own.

I have;

A Mac Book Pro 15" (with Apple care).
iPhone 4.
iPad 1. (with Apple care)
Time Capsule 1TB.
Magic trackpad.
Wireless keyboard.
Apple rechargeable batteries and charger.
iPod classic.

I am delighted with all the above, all are currently used. I am clearly not an Apple hater but in the same token I do not have a rose tinted view of their company..

As to the original post, I regard the actions that Samsung are taking are a direct result of the actions Apple have taken. Both companies should stop wasting money with their tit for tat actions and get on with what they do best, and that is to produce stunning electronic consumer products. Those on this forum that are wringing their hands and stamping their feet about Samsung should also show the same amount of frustration with Apple.

To be honest, I do, but I no longer care. This whole battle is becoming so entertaining that I just wish to see it fought out to the bitter end, whatever the outcome.

Am I a terrible person? :(

I'm pretty sure the only place Samsung would have any luck getting an injunction for the iPhone 4S is in South Korea, and I don't think it's even sold there.

I live here, it's sold here through re-sellers, but Apple themselves don't have any actual stores here. Sucks for repairs, but they do have.. 'Authorized' (I think) retailers and repairs.

It's hilarious, and embarrassing at times.

A lot of the times at the gym, news will come on showing information of Sammy and Apple's patent war going on, which can be awkward for the only American in the place. But I just smile and hold my head high.

It's also hilarious because although, yes, the cell-phone market here is completely different and Sammy does sell a lot of phones, the iPhone is INCREDIBLY popular. Unbelievable demand. I can't tell you how many small stores I saw with signage for the yet unreleased 'iPhone 5' back before the 4S's announcement.

Also, the smaller authorized retailers like 'Frisbee' saw waves and floods of people splatting sticky notes on their store fronts for Jobs. I haven't seen that done for anyone else since I've been here...

Apple has already grown on people world-wide. There is not a country that will turn down Apple.

Apple is a pioneer of smartphones? Better not tell companies like HTC, who were making Windows smartphones several years before iPhone was even a glimmer in Steve Jobs' eye.

Plus, if Samsung stayed out of the smartphone world, there's be no iPhone, since Samsung makes parts for both the iPhone and iPad

There are several other suppliers of components. It will be interesting to see though if this gets ugly enough that Samsung will constrain its supply or seek to do some other action. That of course would kill Samsung financially, not something their board would stand for i suppose.

I'm in korea now and its surprising how many iPhones have I have seen here. I have seem a billion samsung galaxy s2 commercials but a billion times more iPhones and iPads. So much for loyalty.

even koreans prefer Iphone.

Sammy is the pride of Korea. Like Sony to Japan, isn't it? I have only been to SK once but i recall Samsung marketing everywhere.

Oh yeah it is, but like user Dammit Cubs says, there's tons of marketing, but I see wayyy more iPhones/iPads. Although the Galaxy Tab here is different.. They use it on a lot of dashboards for the GPS function, and they're allowed to stream live Television in the car while driving, so we see a lot of sport/Korean Dramas.

Also, thought it was pretty funny that Apple is not shipping to SK in even their second wave of countries of distribution. As much as they love it here, they won't even get the 4S for another month, unless they buy it abroad and have it sent over. Smh.

You do know how big of a company Samsung is?

Loyalty doesn't mean you have to force yourself to use a phone you don't want. :p

This all just a money game with shareholders money. Good luck with that sammy, not likely to happen. They seem to be losing overall.

All of these IP law suits do pay a lot of lawyers salaries though and conceivably they buy things which puts some of it back into the economy.

Still you can not help but wonder if they funds would be better spent on:

1. R&D
2. Industrial Design
3. Customer support

Its probably time for some form of IP reform? You think?

Paying these lawyers or not paying these lawyers do not alter the R&D, industrial Design and consumer support budget from a company as big as Apple. Their venture capital and other investments outside of main products rivals that of these lawyer fees alone probably. All companies diversify their assets. If this patent lawsuit didn't come up, it's not like we would be seeing a iPhone 5 right now.

For people that keep flaming Samsung, don't you understand that Apple doesn't get supplied by Samsung because they like Samsung. Thats obvious because look at them going to war with one another. Apple contracts Samsung because they make great parts at I'm assuming a good price. From processors, to chips, to screens, to drives, and more. Stop giving Apple every credit in the book while at the same time ******** on Samsung. They both contribute to the gadgets that you love.
